December 1998 Administration of Justice Bulletin No. 98/03 <br /> <br /> Effect of Agency Restructuring <br /> Effective January, 1, 1999, certain funds specified <br />for or allocated to the Department of Health and <br />Human Services (DHHS) or the Judicial Department <br />must be allocated or transferred to the new Office of <br />Juvenile Justice (O J J). Before January 1, 1999, DFIHS <br />may initiate the grant application and review process <br />for local grants, but may not award grants from funds <br />appropriated to the luvenile Justice Reserve Fund. The <br />local Juvenile Crime Prevention Councils may work in <br />consultation with the local youth services advisory <br />committees in existence on January 1, 1999. in re- <br />ceiving grant funds during the 1998-99 fiscal year and <br />in allocating those funds to local programs. <br /> <br /> Juvenile ,4ccountability Incentive Block <br /> Grants <br /> <br /> Funds appropriated to the luvenile Justice Reserve <br />Fund for the 1998-99 fiscal year may be used as <br />matching funds for federal luvenile Accountability <br />Incentive Block Grants. If North Carolma receives <br />block grant funds, or a notice of funds to be awarded. <br />the Office of State Budget and Management and the <br />Governor's Crime Commission of the Department of <br />Crime Control and Public Safety must consult with the <br />Office of Juvenile Justice about the criteria for award- <br />lng the federal funds, and report to the House and <br />Senate Appropriations Committees and the Joint Leg- <br />islative cormmssion on Governmental Operations <br />before allocating the funds. The report must identify <br />the amount of funds to be received for the 1998-99 <br />fiscal year. the amount of funds anticipated for the <br />1999-2000 fiscal year, and the allocation of funds by <br />program and purpose. <br /> <br /> Block Grant Funds <br /> The Budget Act transfers $1,182,280 from the <br />TANF (Temporary Assistance for Needy Families) <br />Block Grant to the Division of Mental Health. Devel- <br />opmental Disabilities, and Substance Abuse Services <br />for juvenile offenders. Allocations from the Substance <br />Abuse Prevention and Treatment Block Grant include <br />the following: <br /> <br /> · $893.811. for juvenile ser,4ces--family <br /> focus. <br /> · $300,000, for juvenile offender services and <br /> substance abuse pilot. <br /> <br /> Whitaher School Planning Funds <br /> Section 29.5C of the Budget Act appropriates <br />$250,000 to the Department of Health and Human <br />Services (DHHS) for the 1998-99 fiscal year, for plan- <br />ning and'designing a replacement facility for the <br />Whitaker School, a reeducation facility for behavior- <br />ally and emotionally disturbed youth. DHI-IS must <br />provide the plan, design, and estimated costs to the <br />House Appropriations Subcommittee on Human <br />Resources and the Senate Appropriations Commit'lee <br />on Human Resources by May 1, 1999. <br /> <br /> Cumberland County Juvenile Assessment <br /> Center Project <br /> Section 16.6 of the Budget Act rewrites section <br />18.21 of S.L. 1997-443, to <br /> <br /> 1. emend the Cumberland County Juvenile <br /> Assessment Center Project for one year, to <br /> June 30, 1999, and <br /> 2. provide that funds appropriated to the Ad- <br /> ministrative Office of the Courts for the <br /> project for fiscal year 1997-98 do not revert <br /> but remain available during the 1998-99 tis- <br /> cai year to implement the project. <br /> <br /> Project Challenge Funds <br /> <br /> Project Challenge North Carolina is a nonprofit <br />corporation that provides alternative dispositions and <br />services to juveniles who have been adjudicated delin- <br />quent or undisciplined. Section 16.24 of the Budget <br />Act rewrites section 18.20 of S.L. 1997-443, to provide <br />that $100,000 of funds appropriated to the Admimstra- <br />tire Office of the Courts for the 1998-99 fiscal year <br />shall be used to support the operation of the program in <br />district court districts 24, 25.29, and 30. and to expand <br />the program into additional districts. <br /> <br />Facilities Construction <br /> <br /> The Juvenile Justice Reform Act, S.L. 1998-202 <br />(S 1260), authorizes the Office of State Construction of <br />the Department of Administration to contract for and <br />supervise all aspects of administration, technical <br />assistance, design, consauction, or demolition of any <br />juvenile facilities authorized for the 1998-99 fiscal <br />year, including the transformation of existing adult <br />facilities to juvenile facilities. <br /> ffthe Secretary of Administratiott, ia consultation <br />with the Office of Juvenile lustice, determines that the <br />delivery of juvenile facilities must be expedited, the <br /> <br />29 <br /> <br /> <br />
