Box 707 <br />Concord, N.C. 28026- 0707 <br />(704) 788-8100 <br />(704) 788-9820 Fax <br /> <br />update- contract extention request to close 7-30-99 <br /> <br />Dear Mr. Clifton: <br /> <br />January 7, 1999 <br /> <br />Happy new year!l! <br />As you know, I have invested a tremendous amount of time, money and energy into purchasing this 177 <br />acres in Kannapolis, N.C. We anticipated serious challenges regarding working with the known wetlands, <br />floodplains, floodways, impervious water shed requirements, etc. However, we did not anticipate recent <br />Core of U.S. Engineers regulations impact of intersecting stream regulations to seriously reduce lhe <br />usefulness and design of this land as these regulations have done. <br /> <br />We have aggresively pursued all necessary approvals to complete this transaction, although technically <br />our deposit becomes non- refundable at this point, we still have a challenging road of evaluations and <br />approvals ahead as follows: <br /> <br />1) U.S. Core of Engineers approvals (application submitted) <br />2) N.C. State Enviromental approvals (application submitted) <br />3) Kann. engineering approvals <br />4) Water and sewer approvals <br />5) State of N.C. erosion control approvals <br /> <br />Based on the Cores schedule and expected States schedule we expect closing to occur approximately <br />July 30, 1999. with your approval. <br /> <br />Theirfore, we would kindly request an addendum to our original contract to meet all <br />Governmental approvals. Could you please obtain this extention for revised projected <br />closing at your next scheduled County Commissioners meeting? <br /> <br />We have made a sincere and honest attempt to keep you fully informed through your <br />people and pray your patients and understanding continues.
