This requirement shall in no way <br />substitute for or lessen any additional requirements of NCDOT made as part <br />of a required driveway permit. <br /> <br />No lot in major developments (four (4) or more lots/spaces) may access <br />directly to the state maintained road which is used for access. A new interior <br />road that meets the requirements of the Cabarms County Subdivision <br />Regulations must be constructed to access all lots. <br /> <br />3. The front yard of all lots within major developments must be oriented to the <br /> interior access road. <br /> <br />Major developments must include an exterior vegetative buffer meeting level <br />2 bufferyard standards for amount of vegetation on all exterior property lines <br />including those adjacent to rights-of-way. The bufferyard width may be <br />reduced to 50 feet and the amount of vegetation reduced by 50% if an earthen <br />berm or solid fence is employed. The berm or fence must be at least six (6) <br />feet above ground level. <br /> <br />Major developments must include an effort to retain mature trees. Existing <br />trees of 12 inch diameter at breast heighth (dbh) or greater must be identified <br />and shall not be removed except when buildings, roads or required utilities are <br />to be constructed. <br /> <br />o <br /> <br />All new roads shall be constructed to NCDOT standards as prescribed in the <br />Cabarrus County Subdivision Regulations. The Rimertown community shall <br />not be responsible for the maintenance of these roads. A homeowners <br />association or the property developer shall be responsible for maintaining the <br />roads to NCDOT standards until such time as they are accepted for public <br />maintenance. <br /> <br />° <br /> <br />All major developments shall be reviewed based on the adequacy of public <br />services and/or facilities to properly supply the development. Where services <br />or facilities are inadequate to serve the proposed development, it shall not be <br />approved until the necessary services or facilities are adequate to provide <br />those services. Planned improvements shall be considered when determining <br />adequacy. <br /> <br />Section 4-42. Appeals and exceptions. <br /> <br />Where a person, or persons, proposing a major development feels they are not able to <br />meet the requirements of this overlay zone, they may appeal to the County Planning and <br />Zoning Commission acting as a Board of Adjustment. The Board of Adjustment shall <br />consider the appeal as an application for a variance and follow all applicable procedures. <br /> <br /> <br />
