RESOLUTION TO AUTHORIZE CONTRACT FOR FIRE PROTECTION <br />SERVICES IN AN UNINCORPORATED AREA <br /> AND TO LEVY A TAX THEREIN <br /> <br /> WHEREAS, Cabarms County (the "County") is a political subdivision of the <br />State of North Carolina; and <br /> <br /> WHEREAS, the Board of Commissioners of the County (the "Board") is the <br />elected governing body of the County; and <br /> <br /> WHEREAS, North Carolina General Statute 69-25.5 authorizes the Board to <br />enact a fire protection tax in specific districts in the County and to contract with a city or <br />town for fire protection services; and <br /> <br /> WHEREAS, the City of Kannapolis ("Kannapolis") has exercised its municipal <br />authority to annex unincorporated area in the city limits, has annexed into the corporate <br />limits a majority of the "Winecoff Fire Protection Districf' identified in Chapter __ of <br />the Session Laws of 1987, effective June 30, 1999, and has acquired the assets of the <br />Winecoff Fire Depa~h~lent, Inc., with which the County has previously contracted for fire <br />protection services within the Winecoff Fire Protection District; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF <br />COMMISSIONERS OF CABARRUS COUNTY THAT: <br /> <br /> 1. The County and Kannapolis may enter into a contract to provide fire <br />protection service for those remaining unincorporated areas of the "Winecoff Fire <br />District" not included in the area to be annexed into Kannapolis, effective June 30, 1999, <br />to wit: <br /> <br /> (a) The Drakestone Road area, west of Trinity Church Road and east of <br />the Coddle Creek, more particularly described in Appendix A; <br /> <br /> (b) The North Avenue areas, between Concord Lake Road and Dale <br />Earnhardt Boulevard, more particularly described in Appendix B. <br /> <br /> 2. Effective July 1, 1999, a fire protection tax is levied on that property <br />identified in Paragraph 1 at the rate of 3-1/2 cents per $100 valuation. <br /> <br /> Adopted this the __ day of ., 1999, at a duly scheduled meeting of the <br />Board of Commissioners at the Cabarrus County Governmental Center, 65 Church Street, <br />S.E., Concord, North Carolina. <br /> <br />By: <br /> <br />Chairman of the Board of Commissioners <br />for Cabarrus County, North Carolina <br /> <br /> <br />
