Board employee who transfers to the Department shall receive pay and benefits at least <br />comparable to the pay and benefits those employees were receiving fi:om Kannapolis <br />prior to July 1, 1999. During the term of this Agreement, no transferred employees of the <br />Kannapolis Board shall be subject to dismissal or reassignment fi:om the Department <br />without the Director first conferring with the Kannapolis Board Superintendent. An <br />individual currently employed by the County will become an employee of the <br />Depati~nent for purposes of coordinating the maintenance and repair of the School <br />Facilities playgrounds and playground equipment. 'This individual will be called a <br />Maintenance Technician for Repairs, and will receive pay and benefits at least <br />comparable to the pay and benefits received from the County prior to July 1, 1999. This <br />employee may not be dismissed without the Director first conferring with the County <br />Manager. <br /> <br /> In the event this Agreement is temdnated for any reason, the Kannapolis Board <br />represents to the County and the Cabarms Board that the Kannapolis Board will offer <br />Depa~ tanent employees who were previously employed by the Kannapolis Board and who <br />are performing satisfactorily, an opportunity to remm to employment with the Kannapolis <br />Board. However, no term or condition of this Agreement shall be construed to create an <br />employment contract between any or all of the Parties and any Department employee, all <br />of whom are expected to perform satisfactorily and will continue to remain employees at <br />will within the meaning of North Carolina law. <br /> <br /> 4. Department Responsibilities - The Department will have responsibility <br />for providing maintenance and repair (as more fully defined below) for all School <br />Facilities. The Depa~u-nent is authorized to enter into maintenance and repair contracts <br />with third parties. The maintenance and repair services provided by the Department shall <br />include, but are not limited to: <br /> <br />(a) <br /> <br />Grounds work and landscaping - This service shall include but not be <br />limited to, planting, seeding, fertilizing, soil treatment, irrigation, mowing, <br />weeding, leafing, trimming of all School Facilities real property. Grounds <br />maintenance shall be performed in such a manner as to meet the <br />specifications included in existing grounds maintenance con~acts executed <br />by the County. <br /> <br />(b) <br /> <br />Stadiums, playgrounds, athletie and recreational fields - This service <br />shall include but not be limited to, playground equipment affixed to school <br />grounds and maintenance and repair of tennis courts, basketball courts, <br />tracks, scoreboards, maintaining and repairing athletic equipment used on <br />the grounds (whether pe..anent or removable), and all buildings, grounds <br />and facilities affiliated with any athletic program, including without <br /> <br /> <br />
