NC 28O25 <br /> <br />30th <br /> <br />Dear Mr. Hartscll: <br /> <br />In 1967 Cabarms Cot, nty adopted au ordiuancc entitled "Use of Fimarms". <br /> <br />Since becoming Sheriff I have interpreted the ordinance to mean them would have to be two or mom <br />homes and/or homes and businesses situated physically within 300 feet of each other conti,mos along a <br />road frontage to conslitute a residential or business district as defined in the ordinance. <br /> <br />Wc now have a complainaut who adamautly interprets tile ordin,'mce othcm'isc. <br /> <br />Tile complainants interpretation of the ord/nance is fl'.at if you have two or more residential or business <br />eutmuces within a conlh'tuous distance of 31)0 feet along a road or highway then that cousfitutes a business <br />or residential district according to thc ordinance. <br /> <br />I dou't think either interpretation would make complainauts Ilome a residential district because there am no <br />other residences or businesses within 300 feet of his home. <br /> <br />1 have attached an aerial phologmph depicting thc homes involved in this situatiou. <br /> <br />A= Complainants Residence <br /> <br />B= Nearest Neighbor to complainants home <br /> <br />C-- Suspects home (Built since aerial photo taken) <br /> <br />D= Location from which shots .'ire fired <br /> <br />E= Location of Target heing shot at <br /> <br />F= New home built since photo taken <br /> <br />lfwc usc the car on Old Salisbury Road as Iht gnide for scale, approximately 1/Sth inch eqtmls 15 feet. <br />I doubt that our complainant will ever accept anything that is not consistent with his interpretation bnt 1 <br />need a legal counsel interpretation of this ordinauce so that I along with Johu Q.
