BOARD OF COMMISSIONERS <br />Monday, December 20, 1999 ~c,,i~'d: __ <br /> I ablcd: <br /> <br />along Pharr Mill Road with any additional on and off site improvements as <br />determined by NCDOT. <br /> <br />At build-out, this subdivision may add approximately 301 (501 lots x .60) <br />children to the Cabarrus County school system. Please refer to Exhibit 3 for <br />information pertaining to the addition of children and impacts to the existing <br />school system. Robert Kluttz states in 2001 Southwest Cabarrus High <br />School will be operational and accept 500 students from Central Cabarrus <br />High School reducing the secondary school over capacity issue. The School <br />Board is seeking funding for the construction of two (2) middle schools in <br />2002 reducing the J.N. Fries Middle School over capacity issue. Currently, <br />capacity is available at the Rocky River Elementary School. <br /> <br />With regard to adequate public facilities, the applicant is offering to donate <br />35 acres of the property, located east of Pharr Mill Road and north of the <br />AT&T right-of-way, to the School Board for the possible construction of a <br />future school. The School Board has indicated they will accept the site only <br />if is donated free and clear of any conditions. The School Board is not <br />bound to construct a school on the site at any time. The applicant's desire is <br />to preliminarily subdivide the 35 acres. If the School Board decides not to <br />build a school, they have proposed to offer the applicant right of first refusal <br />to match the negotiated price of the property, and he would then be <br />permitted to develop the property according to an approved plan. Please <br />refer to Exhibit 2 for additional details. <br /> <br />It should be noted that if the 35 acres of land is dedicated for public use, <br />Cabarrus County should originally receive the property with no additional <br />conditions. <br /> <br />Staff has reservations whether this site will satisfy the requirements <br />established within the Adequate Public Facilities Ordinance. Approximately <br />37 percent of the site is located within the 100-year flood plain. The <br />applicant has not offered a market value of the property when establishing <br />the worth of the property. Currently, two of the three schools that will be <br />impacted by this subdivision are operating over capacity with relief no <br />sooner than 2001. <br /> <br />Staff Recommendation: <br /> <br />P&Z Commission: <br /> <br />Staff has a neutral recommendation of the preliminary plat for Cantedield <br />Estates Subdivision since the proposal meets the bulk requirements <br />established in the Zoning Ordinance but not the intent of the Adequate <br />Public Facilities Ordinance. Staff would like to make a condition that <br />adequate turn lanes be constructed along Pharr Mill Road with any <br />additional on and offsite improvements as determined by NCDOT. <br /> <br />The Planning and Zoning Commission, at their regular meeting of <br />November 18, 1999, voted unanimously 9 to 0 to deny this request until <br />such time that school facilities are adequate to serve the growth generated <br />by this proposal. <br /> <br />Page 3 o1'3 <br />Cat~tcrJ~cld klstatcs <br /> <br /> <br />
