473 MEMO~%NDUM OF UNDERSTANDING between THE CITY OF CONCORD, THE CITY OF K~RNAPOLIS, THE COUNTY OF CABARRUS, AND THE CAEARRUS SOUTH ROWAN URBAN AREA METROPOLITAN PIJ%NNING ORGANIZATION (MPO) FOR PREPARATION OF A UNIFIED DEVELOPMENT O~INANCE (UDO) WITNESSETN DRAFT TEAT WEEREAS, there is desirability to have the same Zoning and Subdivision Ordinances among all Jurisdictions within Cabarrus County in that common regulations would be favorable for citizens, developers and staff; and W~iEREAS the City of Concord entered into a decision to revise its Zoning Ordinance and Subdivision Regulations, through the use of a planning consultant; and ~EREAS, the City of Kannapolis and cabarrus County have agreed to participate in the selection of the consultant and in the preparation of both a Zoning Ordinance and Subdivision Regulations into one document, known as a ~'Unlfied Development Ordinance: or "UDO;" and WHEREAS, after interviews and deliberations, the jurisdictions have selected Freilich, Leitener, and Carlisle (hereafter known as 'FLC") of Kansas City, Missouri to prepare the UDO, and W~EREAS, the City of Kannapolis and Cabarurs County have agreed to contribute funding for compensation of FLC; and WHEREAS, part of the scope of the UDO will include regulations for the provision of adequate public facilities, which will include roads and transportation; and WHEREAS, drafting and adoption of these provisions of the UDO will forward the transportation planning goals and mission of the MPO; and WHEREAS, the ~ has in its Planning Work Program available funding for Collector Street Planning, Administrative Controls, and Corridor Planning, which will be part of the UDO. NOW, THEREFORE, the parties hereto do mutually agree as follows: SECTION 1: It is hereby agreed that the City of Concord will act as lead agency in the development of the UDO, and shall be responsible for the compensation of the consultant, as specified in the approved contract. SECTION 2: It is hereby agreed that the project shall consist of at least four phases, with Phase I of the project beginning immediately, and with Phase II ending on June 30, 1998. SECTION 3: It is hereby agreed that Cabarrus County and the City of Kannapolis will each advance $25,000 to the City of Concord for Phases I and II. This total of $50,000 shall be added to the $25,000 budgeted by the lead agency. SECTION 4: It is hereby agreed that the MPO will contribute $10,000 to the City of Concord for preparation of the UDO. SECTION 5: It is hereby agreed that the City of Concord, the City of Kannapolis and Cabarrus County will each budget $25,000 for Fiscal Year (FY) 98-99, for Phases III and IV, to commence on July 1, 1998. This agreement is contingent upon the inclusion of this amount ie the 1998-99 budget. If during the progress of the project additional tasks listed under Phase V are necessary, or desired by individual jurisdiction, the respective jurisdiction shall budget separately for those items. SECTION 6: It is hereby agreed that the jurisdictions will furnish staff, and appropriate documentation, as necessary, to assist the consultant.
