C. Leased Access Channels. Franchisee shall offer leased access channels <br />at such terms and conditions and rates as may be negotiated with each lessee subject to <br />the requirements of Section 612 of the Cable Act. <br /> <br /> D. Cable Drops and Monthly Service. Franchisee shall provide one free <br />cable drop and one outlet of free, basic service and the cable program service tier <br />package to any County designated public buildings, Rowan-Cabarrus Community <br />College, public schools, and secondary private schools that receive funding under Title <br />I of the Elementary and Secondary Education Act of 1965, which may be served by a <br />one hundred fifty (150') foot installation. All basic tier and the cable programming <br />service tier packages and closed circuit training programming shall be provided free of <br />charge to all of these locations. Each free drop location will be provided with one free <br />converter if necessary for cable programming and closed-circuit reception. However, <br />nothing herein shall require Franchisee to maintain or repair any equipment or wiring <br />not provided by it. <br /> <br />XII. ACCESS EQUll~MENT AND SERVICES <br /> <br /> In order to develop and promote public educational and government access <br />programming for the system's access channels, Franchisee hereby agrees to provide the <br />following. <br /> <br /> A. Access Channels. During the rebuild, Franchisee shall maintain and <br />provide without charge the following access channels: <br /> <br />(a) Government Access which is a specifically designated channel <br />for the shared use of local governments served by the system. <br /> <br /> (b) Educational Access which is a specifically dedicated channel for <br /> use by local educational entities as designated by local <br />governments served by the system. <br /> <br />(c) Leased Access operated by Grantee. <br /> <br /> Franchisee shall supply, without charge, the following access channels upon <br />completion of the rebuild: one government access channel; and, one educational access <br />channel for the shared use of local governments served by the system. <br /> At any time during the franchise term, the County may designate capacity on <br />the access channels for public access programming. In addition a third access channel <br />shall be reserved for future use. After the rebuild and upon request of the County, <br />whenever two channels as set forth in this section show documented proof of <br />performance that they are in use for any 6 week consecutive timeframe, given at least 8 <br />hours per day, 7 days per week cablecast schedule, with at least 40 % (of the time the <br />channels are programmed) with unduplicated full motion video programming, the <br />Grantee shall make such additional access channel available as necessary for access use <br /> <br />9 <br /> <br /> <br />
