March 10, 1998 <br /> <br />ICAI]AFtflUS COllNPr I <br /> <br />N08[l CAROUNA <br /> <br />MEMORANDUM <br /> <br />TO: Board of Commissioners <br /> <br />RE: Protection of Planted Buffer at Coddle Creek Reservoir <br /> <br />Recently, two different incidents have resulted in the cleating of county-owned land adjacent to the <br />Coddle Creek Reservoir. In each case, the individuals responsible have been identified. <br /> <br />The County has an obligation to maintain a planted buffer around the Reservoir and did under the <br />direction of the State plant some areas surrounding the Reservoir. We need to establish by ordinance <br />restrictions prohibiting further destruction of planted areas at the Reservoir. <br /> <br />The Board is asked to: <br /> <br />(1) <br /> <br />Direct staffto seek correction of damage done to existing buffers at Coddle Creek Reservoir <br />inclusive of any legal action necessary to obtain corrective action and financial restitution <br />from those individuals responsible for the damage. <br /> <br />(2) <br /> <br />Direct the County Attorney to develop an appropriate ordinance that will prohibit such further <br />damage, establishing penalties and corrective action claim processes. <br /> <br />While these actions may seem unique, the County remains responsible for the water quality in Coddle <br />Creek Reservoir and has a multimillion dollar investment in the facility. <br /> <br />Respectfully, <br /> <br />FWC/sb <br /> <br />CC; <br /> <br />Fletcher Hartseli <br />John Murdock, WSACC <br /> <br /> Office of the County Manager <br /> <br /> P 0 Box 707 · Concord, NC 28026-0707 · (704) 788-8100 · Charlotte 375-0829 <br /> <br /> <br />
