MEMORANDUM

ICASARI~I]$
N~RIH CA~OLINA

TO:

Frank Clifton, Cabarrus County Manager

FROM: Jonathan B. Marshall, Planning Services Director

DATE: March 9, 1998

SUBJECT: Kannapolis Request for Extraterritorial Jurisdiction

The attached letter and resolution are a request from the City of Kannapolis for
extension of extraterritorial jurisdiction in their Area I annexation.

I have reviewed this request and am recommending that you consider a resolution, also
attached, to grant this request. There are some concerns with granting this request, but
the Kannapolis City Council and staff have made assurances that will address these
concerns. Some of the issues that we have discussed include:

1)

2)

3)

Protection of non-residential areas. Despite some statements to the contrary there
are considerable non-residential districts within Area I. Kannapolis has indicated
through their resolution and in conversation, however, that they will protect and
possible increase the non-residential zoning.

Protection of the Westside Bypass corridor. The County currently protects the
corridor of the Westside Bypass through the Thoroughfare Overlay Zone Provisions
of the County Zoning Ordinance and has been doing so since 1988. Kannapolis
staff has indicated that they have already made provisions in their zoning ordinance
to continue to protect the planned road corridor.

Continuation of shared city/county services. The County currently provides
building inspection and sediment and erosion control services in Area I. The
resolution from the Kannapolis City Council indicates they will continue to contract
for building inspection services. I have also included the continuation of sediment
and erosion control services in the resolution from the Board of Commissioners
agreeing to the extraterritorial jurisdiction extension.

Planning Services Division

P.
