Resolution No. 1998-11 <br /> <br />A RESOLUTION AUTHORIZING ~ CITY OF KANNAPOLIS TO <br />EXERCISE EXTRATERRITORIAL JURISDICTION WITHIN THE "AREA I" <br />ANNEXATION AREA <br /> <br />WHEREAS, on June 24, 1991, the City Council of the City of Kannapolis adopted an <br />ordinance annexing an area in Cabarrus County contiguous to the City of Kannapolis <br />and referred to as annexation "Area I'; and, <br /> <br />WBlZ~REAS, the effective date on the annexation "Area I' is June 30, 1999; and, <br /> <br />WB~REAS, there exists a very positive environment among the local govemments of <br />Cabarrus County and all of these government entities are participating in a wide array <br />of cooperative and coordinated efforts aimed at reducing costs, providing better public <br />service and improving the overall quality of life in the County for the next century; and <br /> <br />WHEREAS, the City of Kannapolis, City of Concord, Town of Harrisburg, Town of <br />Mt. Pleasant and Cabarrus County are participating in the preparation of a Unified <br />Development Ordinance that will not be completed for at least one year; and <br /> <br />WHEREAS, the City Council of Kannapolis has expressed their desire by resolution to <br />begin planning and regulatory control in annexation "Area I' to define future economic <br />development areas for the further expansion of tax base to benefit the citizens of <br />Kannapolis and Cabarrus County; and <br /> <br />WltEREAS, the construction of the Westside Bypass will begin in the next Federal <br />Fiscal Year with that construction increasing access and interest in annexation "Area I' <br />and the City of Kannapelis has demonstrated their desire and ability to protect the <br />planned corridor for the Westside Bypass; and <br /> <br />WHERAS, the City of Kannapolis has positioned itself to expend considerable public <br />funds to extend into annexation "Area I' police and fire protection, water and sewer <br />service, garbage collection, street maintenance, street lighting, and other general <br />government functions and facilities; <br /> <br />NOW THEREFORE, BE IT RESOLVF~, by the Board of Commissioners of <br />Cabarrus County: <br /> <br />1) <br /> <br />That the Board of Commissioners permit the City of Kannapolis to establish <br />Planning and Development Regulations within the area known as annexation "Area <br />I', which is described in Attachment A and shown on the attached map, for the <br />purpose of the City of Kannapolis exercising Extraterritorial Jursdicfion within the <br />area, as set forth in North Carolina General Statutes Section 160A-360. <br /> <br /> <br />
