S29 <br /> <br />special additional or customized equipment is requested by any subscriber or <br />is required to provide service to any subecriber, Franchisee may charge the <br />subscriber for such equipment. Concurrently with the start of the rebuild <br />construction project, Franchisee will issue information to the local media <br />advising that Franchisee will be notifying subscribers of the pro,eot schedule <br />section by section. Additionally, Franchisee shall notify in advance the <br />subscribers in the area due to be cut over of the impending conversion. <br /> The existing cable system will continue to operate and serve customers <br />throughout the rebuild construction assuring continuous cable service <br />throughout the County. Customers in active construction areas may experience <br />some minor interruptions generated from signal path routing changes, <br />reconfiguration of powering, or fiber-optic construction. In order to <br />minimize the impact on customers, these interruptions, if any, will be planned <br />and executed, whenever possible, between the hours of l:O0 a.m. and 5:00 a.m. <br /> Construct£on areas will include approximately 500 - 1,000 passings. <br />Once construction is completed in a specific service area, customers will be <br />transferred from the existing cable system to the rebuilt eyetem between the <br />hours of 7:00 a.m. and 5:00 p.m., whenever possible. This transfer will <br />reeult in a service interruption during this time frame. Subscribers affected <br />by each passing will be notified one to three days prior to this interruption. <br />Construction personnel will remain in the area until 7:00 p.m., at a minimum, <br />to assure that the system is operating and that all customers are receiving <br />service. <br /> Property damage or disturbance shall be minimal. Any property disturbed <br />will be restored following the completion of construction in a given area. <br />On-site supervision and inspection of all work will be made on a daily basis. <br />Should any property damage be identified that is not being restored through <br />normal procedures, it will be reported to the site supervisor for immediate <br />attention and the property will be restored to the owner's satisfaction as <br />quickly as possible. <br /> E. County Construction Notification. Franchisee shall provide the <br />County with a detailed construction plan, within thirty (30) days of <br />initiating construction and phases of construction work. The County shall <br />designate the County Manager of the County of Cabarrus to receive <br />notification. <br /> F. Consumer Compatibility. Franchisee shall comply with FCC consumer <br />compatibility rules and guidelines and will use reasonable efforts to provide <br />subscriber friendly technology. The basic tier of service shall be offered in <br />a format compatible with FCC regulations. <br />XI. SYSTEM SERVICES AFTER REBUILD <br /> A. Initial Residential Subscriber Services. During the rebuild <br />period, Franchisee shall initially provide the programming as provided in the <br />Channel lineup included in Appendix A. <br /> B. Rebuilt System. After Franchisee completes converting subscribers <br />to the rebuilt system, Franchisee shall maintain the mix, quality, and level <br />of programming provided at the time of conversion to the rebuilt system. Upon <br />completion of the rebuild as described herein, the system will be capable of <br />delivering up to 77 programming channels. <br /> C. Leased Access Channels. Franchisee shall offer leased access <br />channels at such terms and conditions and rates as may be negotiated with each <br />lessee subject to the requirements of Section 612 of the Cable Act. <br /> D. Cable Drops and Monthly Service. Franchisee shall provide one <br />free cable drop and one outlet of free, basic service and the cable program <br />service tier package to any County designated public buildings, Rowan-Cabarrus <br />Community College, public schools, and secondary private schools that receive <br />funding under Title I of the Elementary and Secondary Education Act of 1965, <br />which may be served by a one hundred fifty (150') foot installation. All <br />basic tier and the cable programming service tier packages and closed circuit <br />training programming shall be provided free of charge to all of these <br />locations. Each free drop location will be provided with one free converter <br />if necessary for cable programming and closed-circuit reception. However, <br />nothing herein shall require Franchisee to maintain or repair any equipment or <br />wiring not provided by it. <br />XII. ACCESS EQUIPMENT AND SERVICES <br /> In order to develop and promote public educational and government access <br />programming for the system's access channels, Franchisee hereby agrees to <br />provide the following. <br /> A. Access Channels. During the rebuild, Franchisee shall maintain <br />and provide without charge the following access channels: <br /> (a) Government Access which is a specifically designated channel <br /> for the shared use of local governments served by the system. <br /> (b) Educational Access which is a specifically dedicated channel for <br /> use by local educational entities as designated by local <br /> <br /> <br />
