Staff would support, however, the <br />rezoning of all the properties accessed by Mullis Road such that <br />they all have the same zoning. It would be different from the <br />larger area, but as discussed Mullis Road itself is unique within <br />that area. <br /> <br />The Chair opened the Public Hearing on Petition 97-13. <br /> <br />The Chair closed the Public Hearing on Petition 97-13. <br /> <br />There being no further comments, Mr. Moose MOTIONED, <br />seconded by Mr. Dwiggins to approve Petition 97-13 as modified <br />by staff. The vote was unanimous. <br /> <br />New Business <br /> <br />The Chair introduced the first item of new business on the Agenda, Preliminary <br />Subdivision Plat Approval: <br /> <br />Applicant: Westbrook Highland Creek~ LLC <br />Request: Preliminary Subdivision Plat Approval <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Westbrook Highland Creek, LLC to have their <br />subdivision Highland Creek plat approved preliminary. <br /> <br />Mr. Jonathan B. Marshall, Planning Services Director, addressed <br />the Board stating this subdivision has a planned unit'development <br />zoning from our old ordinance as well as a medium density <br />residential zoning under our current ordinance. The staff <br />recognizes a plan that had been submitted and approved by the <br />Board of Commissioners in 1990 that approved this overall parcel <br />of land which they are developing for 1,500 units. It did have a <br />base lot size of 9,000 square feet. It is the applicants' option to come <br />back before the Board and ask for development approval using the <br />current zoning. Mr. Marshall said staff recommends the 100 year <br />flood line be determined from field survey work prior to building <br />pel~atits being issued for any lots adjoining the creek. A certificate <br />of elevation will be required for all lots with a substantial area in <br /> <br /> <br />
