581 <br /> <br />The entrance will be off Flowes Store Road and there will be a recycling center <br />on site for yard waste for composting and mulching. Further, Mr. Gilkerson <br />advised that there will be ground water monitoring wells located around the <br />perimeter of the property. He addressed concerns of the residents regarding dust, <br />noise and property values. All roadways on the interior of the property will be <br />irrigated and an earth berm will be built around the site for noise abatement and <br />to prevent unauthorized access. He presented written information concerning an <br />increase in property values in areas located near the BFI Landfill at the <br />Charlotte Motor Speedway, the tire recycling facility on Poplar Tent Road and the <br />proposed C&D landfill. Mr. Gilkerson reported~there were no documented cases of <br />methane gas in a C&D landfill in the state and only one documented case of <br />groundwater contamination which involved a crossover of municipal solid waste. <br />The company has revised its hours of operation as follows: 7:00 am to 6:00 pm on <br />Monday through Friday and 7:00 am to 12:00 noon on Saturday. In conclusion, Mr. <br />Gilkerson advised the company proposes to donate the completed landfill to <br />Cabarrus County to be used for recreational purposes. Also, he said the company <br />is proposing a donation (amount to be determined) on a price per ton basis of the <br />Landfill's tipping fee to the County for assistance with the schools. <br /> <br /> At 8:28 P.M., Chairman Casper opened the public hearing for Petition C98- <br />Ol(R). She asked speakers to limit their comments to two (2) minutes. <br /> <br /> Mr. Jim Scarbrough, Attorney representing residents of the conununity, <br />introduced the presentation in opposition to the rezoning. He pointed out the <br />petition was denied by the Planning and Zoning Commission and brought to the <br />Board of Commissioners on appeal. He stated that rezoning this property for a <br />landfill would constitute spot zoning as it cannot be justified under any of the <br />following factors: (1) The size of the tract of property; (2) The compatibility <br />of the disputed action with an existing comprehensive zoning plan; (3) The <br />benefits and detriments for the owner, his neighbors and the surrounding <br />community; and (4) The relationship of the uses envisioned under the new zoning <br />and the uses currently present on adjacent tracts. <br /> <br /> Mr. John Boger, resident of 101 Louise Drive SE in Concord and speaking on <br />behalf of his mother, opposed the rezoning. He stated there is nothing unique <br />about the size of this tract of land that justifies zoning this property in a <br />manner inconsistent with the surrounding area. Mr. Boger submitted a County <br />Geographic Information Services map, which he stated showed rolling land at <br />approximately 630 feet above sea level. He said the proposed landfill will <br />extend approximately 100 feet above the surrounding property and will destroy the <br />value of other land in the area. <br /> <br /> Mr. Mark Horton of 7787 Highway 601 South, Concord, opposed the rezoning. <br />He stated the Board should adhere to the Midland Area Plan which shows the land <br />use as rural residential and agricultural. Also, he complained that the proposed <br />landfill would change the character and heritage of this land and surrounding <br />area. <br /> <br /> Mr. Art Spellenberg of 710 Palafox Drive, Concord, objected to the proposed <br />landfill. He stated the landfill operator will receive all the benefits and the <br />community will receive all the detriments, including traffic, odor and noise. Mr. <br />Spellenberg presented information regarding reported vehicle crashes in the area, <br />traffic count, area school bus routes and the unsuitability of the roads to <br />withstand sustained heavy truck traffic. He objected to plans for a future park <br />at the site, stating the County would be financially responsible for monitoring <br />a closed-out landfill. In conclusion, Mr. Spellenberg presented a photograph of <br />a lO0-foot tower at Concord Motorsports Park and stated the landfill would extend <br />to the height of that tower. <br /> <br /> Mr. Lester H. Cragan, III, of 6683 Erinbrook Drive, Concord, objected to the <br />rezoning. Stating the landfill would create methane gas, he expressed concern <br />about the creation of an explosive atmosphere and the water availability if a <br />fire should occur. Mr. CragaN further expressed concern about 'the possibility <br />of contaminated dirt being brought in to the site and the County's liability if <br />a park is developed at the site. <br /> <br /> Mr. David Black of 8800 John White Road, Concord, stated rezoning the <br />property for a landfill violates the Midland Area Plan and would be a detriment <br />to the co--unity. He discussed the makeup of the surrounding area, including the <br />location gf both residences and churches. <br /> <br /> Miss Amanda Creason, area resident, spoke in opposition to the landfill. <br /> <br /> <br />
