Planning and Zoning Commission Minutes
June 18, 1998

Page 3

limited commercial when it went before the Commissioners and it got
turned down. He said he need to move from where he is now. He is in
a subdivision now and he is grandfathered in, but he needs a major
thoroughfare to be right on his property. He said there are already three
businesses across the street, and he does not think another business is
going to make that much difference. Mr. Foster said to the Board he
would just like to get this property rezone&

The Vice Chair dosed the Public Heating on Petition C98-090t ).

Mr. Dwiggins said he is having a problem finding contractor storage in
this permitted use.

Mr. Byrd said with a straight rezoning you cannot question a specific
use. This would just be a straight rezoning for any of the uses permitted
under that zone.

Mr. Marshall said it is a degree of uses. If there is a lot of storage of
material out there, then it is a contractor's storage yard and that requires
a general commercial. If it is mainly their offices, then it can fall under
the professional office. If it is rezoned, you will need to consider all
these uses as possibilities because it is a straight rezoning. If it is
rezoned, he will have to go through Mike Downs, Zoning Administrator,
who makes the final determination of what the use is. He will oversee it
and make sure it is in compliance.

There being no further comments, Mr. Ritchie MOTIONED, seconded
by Mr. Dwiggins to approve Petition C98-09(R). The vote was 7 to 1,
Ms. Kiker dissenting.

The Chair introduced the second item on the Agenda, Subdivision Text Amendment,
Petition C98-03(S):

Applicant: Planning Services Staff
Request: Subdivision Text Amendment

This was a request to the Cabarms County Planning and Zoning
Commission from the Cabarrus County Planning Services Division to
amend the Cabarrus County Subdivision Ordinance (Article II, Section
66-39(A)), by changing the submission deadline and the nunib~r of
