Assuming for argument's sake that the ordinance is constitutional and authorized by the General <br />Assembly (which the petitioner denies for the reasons previously stated), it is impermissible for <br />the County to apply it to some but not all property owners. To comply with the mandate of the <br />equal protection clause, the moratorium imposed must be applied to all property owners in the <br />County, or to none of them. <br /> <br /> 6. For such other reasons as may be determined when this matter is heard by the <br /> <br />Board. The grounds upon which the petitioner contends that it is entitled to have its plat <br />approved arise from review of the decision of the Commission denying such approval. If other <br />grounds are dete,i~ined to be appropriate at the hearing before the Board, they will be asserted as <br />well. <br /> <br /> <br />
