PLANNING STAFF REPORT TO
CABARRUS CO. BOARD OF COMMISSIONERS
Monday, July 13, 1998

Staff' Use Onl.5:
Aot.'l'oved:

Denied:
Tabled:

W.R. Odell is very near capacity, while Northwest Middle and High schools are well over their capacity.
With the extremely large number of proposed lots in Highland Creek, Mr. Kluttz has stated that unless
additional resources are provided for school property and construction, this proposed development should
be denied.

Sheriff's Dept: Phil Patterson

The Sheriff's Department will be able to provide adequate service to the proposed development without
straining existing personnel or facilities.

Soil Conservation: Dennis Testerman

Mr. Testerman was glad to see that the proposed development set aside a large amount of greenway area
along Clarke Creek

WSACC: Mark Lomax

WSACC agrees that the public facilities are adequate for it's wholesale wastewater transportation and
treatment services and has agreed to accept the anticipated wastewater flows. Since the proposed systems
are to be constructed in accordance with WSACC's standard specifications, adequate services will be
provided within this subdivision.

Zoning and Subdivision Regulation: Mike Downs and Mike Byrd

The proposed development was originally approved in 1990 as a Planned Unit District (PUD). Although
the current zoning is MDR, the proposal reflects the PUD concept. The developers are maintaining that
they have a vested right to develop a maximum of 1,134 single family dwelling units based on the 1990
approval.

Conclusions:

Westbrook Highland Creek, LLC has submitted this preliminary plat for
approval by the Cabarrus County Planning and Zoning Commission.

The subdivision is residential in nature. R consists of 847 lots. Each lot will
have access to water and sewer service provided by the City of Concord.

At build-out, this subdivision may add approximately 508 children to the
school district. Please see Exhibit 2 for information pertaining to the
addition of children to the school system.

Currently, J.N. Fries Middle, Northwest Cabarrus Middle, Central Cabarrus
High, and Northwest Cabarrus High schools have been "capped" by the
school board and are not enrolling students at this time.

There are numerous other subdivisions located in this school district that
currently have approved lots. These lots' impact on this school district must
be taken into consideration when reviewing the Highland Creek proposal.

Highland (?reek
