Planning and Zoning Commission Minutes <br />March 20~ 1997 <br /> <br />Page 17 <br /> <br />The Chair swore in Mr. Carroll Mullis and Mr. Jonathan B. <br />Marshall, Planning Services Director. <br /> <br />Mr. Jonathan B. Marshall, Planning Services Director, addressed <br />the Board presenting Petition 97-05 and Staff Analysis stating there <br />have been no previous rezonings, but this board has granted an <br />exception from the Subdivision Regulations for excess to allow 15' <br />right-of-way to serve two parcels. Should this be granted and they <br />subdivide it to have the existing mobile home and the one they are <br />requesting, then this 15' right-of-way would be in this case <br />adequate because the Board had previously approved that. Staff <br />recommends approval. <br /> <br />There being no further comments, The Chair MOTIONED to <br />approve Petition 97-05 as submitted, seconded by Mr. Kiefer. The <br />vote was unanimous. <br /> <br />The Chair introduced the fifth item on the Agenda Zoning Atlas Amendment, <br />Petition 97-06: <br /> <br />5. Applicant:. Doug Foster <br /> Request: Zoning Atlas Amendment <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Mr. Douglas M. Foster, PIN 4681-49-5378, to <br />have this property located on the south side of Davidson Highway, <br />just west of Odell School Road, rezoned from Low Density <br />Residential to General Commercial to build a small office building <br />on the back part of the property and a gas station on the front part <br />of the property. <br /> <br />Ms. Linda Giltz, Planner, addressed the Board presenting Petition <br />97-06 and her Staff Analysis stating that she discussed with the <br />petitioner about changing his rezoning request to Limited <br />Commercial versus General Commercial because Limited <br />Commercial seems more consistent with the area. Also that the <br />school and fire departaient are adjacent to the property and they <br />buffer the Limited Commercial area that exists on the north side of <br />Highway 73. The problem with Limited Commercial zoning for <br />the petitioner was the issue of outside storage. He also did not <br /> <br /> <br />
