The guidelines say it <br />should border other commercial or industrial or high density <br />residential and if it borders high density residential, then there <br />should be a buffer. <br /> <br />Mr. Hobbs said it is permitted to border a higher density property <br />residential, with buffering, but it does not say it can border a lower <br />density, which we have here. <br /> <br />Ms. Giltz said that is correct. <br /> <br />There being no further comments, Mr. I<iefer stated if you rezone it <br />high density residential you can put 18 units an acre in there that <br />would over burden the schools, so to help the schools Mr. Kiefer <br />MOTIONED to approve Petition 97-06, seconded by Mr. Drye. <br />The vote was 5 to 4. Mr. Kiefer, Mr. Drye, Mr. Ritchie, Mr. Babb <br />and Mr. Lane voted in favor of the Motion. Mr. Moose, Mr. Hobbs, <br />Mr. Hill and Mr. Dwiggins dissented the Motion. <br /> <br />The Chair opened a Public Forum for anyone who had business before the <br />Board. <br /> <br />Ms. Chaonn Hoyle addressed the Board about the Rocky River <br />Elementary School stating she lives across the street from the <br />school. She said she sent in an appeal about the zoning the Board <br />put for continuous use for this school because she did not receive <br />notification. She said according to the zoning pamphlet, the school <br />board was suppose to do the research and make sure all the <br />property owners were notified. She asked if that was correct. <br /> <br />The Chair said staff does that. That is not a law, it is a courtesy. <br /> <br />Ms. Hoyle said she find it hard to believe that she got overlooked <br />considering she have lived in the same house for 25 years. She said <br />her problem is the letters that were sent out said to construct a new <br />school, and the school was 75% built. She said she listened to the <br />tape of the last zoning meeting and some of the board members <br />actually said how can this happen, aren't we suppose to do this <br />before the fact, not after the fact. She said Mike Downs, Zoning <br />Administrator, response was it was overlooked. It was a law that <br /> <br /> <br />
