CONTRACT FOR FOOD SERVICES THIS AGREEMENT, entered into as of this first day of July, 1997 by and between Service America Corporation, hereinafter referred to as the "Caterer" and Cabarrus County Department of Aging hereinafter referred to as the "Purchaser". WITNESSETH THAT: WHEREAS, the Purchaser desires to engage the Caterer to render services in connection with a nutrition program for the elderly hereinafter referred to as the "Program", provided through the Older Americans Act grant funds provided to the Purchaser throuKh the Centralina Council of Governments from the North Carolina Division of Aging and the United States Department of Health and Human Services; and WHEREAS, the Caterer is a food service management company with the demonstrated capacity and desire to supply services; NOW THEREFORE, in consideration of the premises and the mutual covenants and agreements hereinafter contained, the parties hereto agree as follows: The Caterer agrees to sell and the Purchaser agrees to buy all Purchaser's requireme.,nts for this program according to the provisions of the agreement. Caterer agrees not to sub- contract for the delivery of the services called for in this agreement. o This Agreement will be in effect and services will be delivered beginning July 1, 1997 and continue through June 30, 1998. This contract may be renewed for additional 12 month periods upon agreement of both parties. Such agreements must be reached on or before April 15 of the contract period in order to allow adequate time to complete the bid process if necessary. This contract may be renewed one more time. The Purchaser will order from the Caterer approximately of 190-230 meals daily for approximately 250 serving days, depending on the availability of funding. Caterer shall be obligated to deliver meals to six (6) sites designated by the Purchaser if funding allows these six (6) sites to remain open. The Caterer will deliver meals in bulk to each site Monday through Friday, during the period of this agreement with the exception of the holidays specified in Schedule "A" Special Conditions, or except as provided for under Item 8 presented below. o The purchase and delivery price for all meals ordered by the Purchaser shall be as follows: a unit price of $2.757 plus applicable sales tax. The purchase price shall include disposable supplies delivered by the caterer to the meal sites as follows: Nine inch by twelve inch six-compartment trays-either China School Lunch Tray (22020, China Foam Tray, Foamware 10-955, Amoco China Foam 33-235 or equal. laminated (30-256), be Nine Ounce Styrofoam cups. Plastic-ware kits, (sealed), medium weight plastic knives, spoons, forks. Napkins, one-quarter fold. Trash can liners, forty gallon heavy weight, two mil.weight. Disposable plastic gloves. Straws for milk containers. Bowls for soups or stew.
