CONTRACT FOR FOOD SERVICES <br /> <br /> THIS AGREEMENT, entered into as of this first day of July, 1997 by and between Service <br />America Corporation, hereinafter referred to as the "Caterer" and Cabarrus County Department <br />of Aging hereinafter referred to as the "Purchaser". <br /> <br />WITNESSETH THAT: <br /> <br /> WHEREAS, the Purchaser desires to engage the Caterer to render services in connection <br />with a nutrition program for the elderly hereinafter referred to as the "Program", provided <br />through the Older Americans Act grant funds provided to the Purchaser throuKh the Centralina <br />Council of Governments from the North Carolina Division of Aging and the United States <br />Department of Health and Human Services; and <br /> <br /> WHEREAS, the Caterer is a food service management company with the demonstrated <br />capacity and desire to supply services; <br /> <br /> NOW THEREFORE, in consideration of the premises and the mutual covenants and <br />agreements hereinafter contained, the parties hereto agree as follows: <br /> <br />The Caterer agrees to sell and the Purchaser agrees to buy all Purchaser's requireme.,nts <br />for this program according to the provisions of the agreement. Caterer agrees not to sub- <br />contract for the delivery of the services called for in this agreement. <br /> <br />o <br /> <br />This Agreement will be in effect and services will be delivered beginning July 1, 1997 and <br />continue through June 30, 1998. This contract may be renewed for additional 12 month <br />periods upon agreement of both parties. Such agreements must be reached on or before <br />April 15 of the contract period in order to allow adequate time to complete the bid process <br />if necessary. This contract may be renewed one more time. <br /> <br />The Purchaser will order from the Caterer approximately of 190-230 meals daily for <br />approximately 250 serving days, depending on the availability of funding. Caterer shall <br />be obligated to deliver meals to six (6) sites designated by the Purchaser if funding allows <br />these six (6) sites to remain open. <br /> <br />The Caterer will deliver meals in bulk to each site Monday through Friday, during the <br />period of this agreement with the exception of the holidays specified in Schedule "A" <br />Special Conditions, or except as provided for under Item 8 presented below. <br /> <br />o <br /> <br />The purchase and delivery price for all meals ordered by the Purchaser shall be as follows: <br />a unit price of $2.757 plus applicable sales tax. <br /> <br />The purchase price shall include disposable supplies delivered by the caterer to the meal <br />sites as follows: <br /> <br />Nine inch by twelve inch six-compartment trays-either <br />China School Lunch Tray (22020, China Foam Tray, <br />Foamware 10-955, Amoco China Foam 33-235 or equal. <br /> <br />laminated (30-256), <br /> <br />be <br /> <br />Nine Ounce Styrofoam cups. <br />Plastic-ware kits, (sealed), medium weight plastic knives, spoons, forks. <br />Napkins, one-quarter fold. <br />Trash can liners, forty gallon heavy weight, two mil.weight. <br />Disposable plastic gloves. <br />Straws for milk containers. <br />Bowls for soups or stew. <br /> <br /> <br />
