Casper
Sue B. Casper, Chairman
Board of Commissioners
ATTEST:
/s/ Frankle F. Bends
Frankie F. Bonds, Clerk to the Board

ZontnK Atlas Amendment (Petition 97-05} - Public Mearin~ - 7:00 P.M.

Petition 97-05. Carroll Mullis, Petitioner, Map/PIN 5633-02-6402,
approximately 8.7 acres off Horseshoe Circle near 1-85. Wish to
rezone from Medium Density Residential to Low Density Residential
Special Use, to permit a double wide mobile home on the property.

Mr. Marshall advised that Petition 97-05 was a Special Use request and
would require sworn or affirmed testimony.

Mr. Hartsell affirmed Mr. Marshall and Mr. Ron Anthony. Also, he later
affirmed Mr. Ed Hill, Chairman of the Planning and Zoning Commission.

Mr. Marshall presented the rezoning request by Mr. Carroll Mullis,
including location of the property, findings and compatibility with other
ordinances, and the staff analysis. The Planning and Zoning Commission
previously granted the Petitioner an exception to the Subdivision Regulations to
divide the property and use a 15-foot right-of-way for access. Stating the
proposed use is in keeping with the development in the area, Mr. Marshall
reported that staffl recommended approval of the petition.

Mr. Hill, advised that the Planning and Zoning Commission found the staff
recommendation to be in order and approved the rezoning request on March 20.

Chairman Casper opened khe public hearing at 7:25 P.M. on Petition 97-05
and asked if anyone were present who wished to address the Board regarding this
rezoning request.

Mr. Ron Anthony, resident of Horseshoe Circle, presented the following
concerns regarding the rezoning request: (1) Other uses that will be allowed on
the property; (2) Placement of 16 vehicles on the property; (3) Placement of a
storage trailer on the property in 1994; and (4) Inaccurate date in the
notification letter for the Planning and Zoning Commission meeting.

Mr. Marshall responded to Mr. Anthony's concerns. (1) The Special Use
rezoning will limit Mr. Mullls to the placement of two mobile homes without going
through another rezoning process; (2) Staff will pursue the issue of the 16
vehicles as a zoning complaint; (3) The Zoning Administrator and Chief Building
Inspector have ruled that mobile homes can be used as storage Units if they are
modified to prohibit future use as a dwelling unit; (4) Property owners were
renotified and a public hearing scheduled before the Board of Commissioners as
a result of the inaccurate notification letter.

Mr. Hill advised that the Planning and Zoning Commission was not aware of
the number of vehicles on the property prior to approval of the rezontng request.

Chairman Casper clarified with Mr. Anthony that he was not in opposition
to the rezontng issue itself but wanted to protect the visual aspects of his
propurty. Mr. AIILJl°~y lndlctlLed that tills was corract.

Commissioner B~rnhart read the following findings of fact into the record
and moved for appkoval of Petltton 97-05 by Carroll Mullts to rezon~
approximately 8.7 acres (Map/PI~ 5633-02-6402) off Horseshoe Circle from Mediua:.
