]BE IT ORDAINED that the following portions of Sections 22-27. 22=28. 22-30, 22- <br />31, 22-32, and 22-33 of the Code of Ordinances. Cabav,~as County. North Carolina, <br />are hereby amended to read as follows: <br /> <br />ARTICLE IL EMERGENCY MANAGEMENT <br /> <br />Sec. 22-26. Short title of article. <br /> <br />This article shall be known and may be cited and referred to ns "Emergency Management Ordinance for <br />the County of C. ab,~rus." (Ord. of 5-7-84, § 1) <br /> <br />Sec. 22-27. Intent and purpose of article. <br /> <br /> (a) It is the intent and purpose of this article to ~'.ab!:.~-~ =.': zffi.~ ~.a'. vA!I ensure the complete and <br />efficient utilization of all of the county's resources to combat disaster resulting from enemy actions or <br />other disasters. <br /> <br />Co) The county e. ffice zf emergency management se~,~tunction will be the =.~.r~r.a'2ng. agent' <br />v..cr m.u a~-'-"A.%' "-n c~:'~nec'..i.~n ;'.~ emergent' management; :.: -.-Ail be t.~e .~nstrument through which the <br />board of commissioners may exercise the authority and discharge the responsibilities vested in them <br />during disaster emergencies. <br /> <br /> (c) This article will not relieve any county department of the moral responsibilities or authority given <br />to it in the special acts or by local ordinances, nor will it adversely affect the work of any volunteer <br />agencies organized for relief in disaster emergencies. <br />(Ord. of 5-7-84, § 2) <br /> <br />Sec. 22-28. Definitions. <br /> <br />The following words, terms and phrases, when used in this article, shall have the meanings ascribed to <br />them in this section, except where the context clearly indicates a different meaning: <br /> <br />Attack means direct or indirect assault against the county, its government, its environs, or of the nation, <br />by forces ora hostile nation or the agents thereof, including assault by bonllaing, conventional or nuclear, <br />chemical or biological warfare, <br />or sabotage. <br /> <br />C~rdinat~r means the ~ir~t~r c~rdinat~r-~f the ceunty emergency management ag~n~, functi~n~ <br />appointed as prescribed in this article. <br /> <br />Disaster means and includes but is not limited to actual or threatened enemy attack, sabotage, <br />extraordinary fire, flood, storm, epidemic or other impending or actual calamity endangering or <br />threatening to endanger health, life or property of constituted government. <br /> <br />Emergency management means, broadly, to carry out the basic govermment functions of maintaining the <br />public peace, health and safety during an emergency. This shall include plans and preparations for <br />protection from, and relief and recovery from, effects of an attack by the forces of an enemy nation or the <br />agents thereof, and it shall also include such activity in connection with disaster. It shall not, however, <br />include any activity that is the primary responsibility of the military forces of the United States. <br />Emergency management shall also mean the employees, equipment and facilities of all county <br />departments, boards, councils, institutions and commissions; and, in addition, it shall include all <br />volunteer personnel, equipment and facilities contributed by, or obtained from, volunteer persons or <br />agencies. <br /> <br /> <br />
