01/18/19B6 1~:80 78~-788-8058 HARTSELL,SPAINHOUR,S PAGE 02/0~ <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />DRAFT <br /> <br /> ORDER CLOS LNG <br />DEDICATED FOlt P~LIC 20AD <br /> <br /> W~EREAS, at the November 6, 1995 meeting of the Board of <br />Commissioners for Cabarrus County {the "Board"), the Board <br />acknowledged receipt of a Petition to adopt a Resolution and Order <br />closing that portion of Northside Avenue extending for a distance <br />of 243 feet west of its intersection with Broadway Btreet (S.R. <br />1111), Midland, Cabarrus County, North Carolina, as is more <br />particularly described in maps on file in the Office of Land <br />Records and/or the Office of the Register of Deeds for Cabarrus <br />County and incorporated herein by reference (the "Road"); and <br /> <br /> WHEREAS, the Board has caused to be published in ~e Co~¢O~ <br />Tr~b~m on Monday, November 20 and 27, 1995, and December 4 and 11, <br />1995, a Resolution declaring its intent to close the Road; and <br /> <br /> W~EREAS, a meeting and public hearing (the "Hearing-l") on the <br />closin~ of the Road was held before :he Board at 7:00 p.m. on the <br />18:h day of December, 1995 in the Commissioners' Room of the <br />Cabarrus County Governmental Center, Concord, North Carolina; and <br /> <br /> WHEREAS, at the Hearing-l, the Board heard all interested <br />persons who appeared with respect to whether closing ~he Road would <br />be detrimental either to the public interest or ~o any individual <br />property rights and at which Robert F. McCoy spoke in opposition to <br />closing the Road; and <br /> <br /> WHEREAS, the Board has caused to be published in /~¢ Com:o~ <br />T~b~¢ on Monday, January i and 8, 1996, a Resolution and Notice of <br />Supplemental Hearin~ regarding its intent to close the Road; and <br /> <br /> <br />
