Wallace Gregory, Jr. <br /> <br />Parcel No. 58549 <br />Project No. 62(N.0.) <br /> <br />STATE OF NORTH CAROLINA ) <br /> : <br />COUNTY OF CABARRUS ) <br /> <br />RIGHT OF WAY AGREEMENT <br /> <br /> THIS INDENTURE, made and entered into this day of <br /> , 19 , by and between CABARRUS COUNTY, hereinafter <br />called "Grantor", (whether one or more), and DUKE POWER COMPANY, a <br />North Carolina corporation, hereinafter called "Company"; <br /> <br />WITNE S SETH : <br /> <br /> That Grantor, in consideration of Ten Dollars ($10.00) and <br />other valuable considerations paid by Company, the receipt of which <br />is hereby acknowledged, does grant and convey unto Company, its <br />successors and assigns, a perpetual easement and right of way, for <br />the purposes and subject to the terms and conditions hereinbelow <br />set out, over and across the land of Grantor (hereinafter <br />"Premises") lying in the State and County aforesaid, acqllired by <br />Grantor by the following: <br /> <br />Deed recorded in Book 86 at page 288. <br /> <br /> As to the premises of the Grantor above described, this <br />Agreement supersedes and cancels the following prior agreement(s): <br /> <br />A~reement recorded in Book 85 at page 247, and <br />A~reement recorded in Book 68 at page 75A~ B~ 5~$ ~T P~o <br /> <br /> The easement and right of way herein granted by Grantor to <br />Company, its successors and assigns, over the Premises above <br />described consist of the following: <br /> <br />1. Right of Way Strip: Within two right of way strips <br />containing a total of 3.58 acres, containing 1.37 acres, <br />and being shown and designated "ARF_J~ 1", and containing <br />2.21 acres, and being shown and designated "Ai{EA 2" on <br />map of Duke Power Company rights of way dated February <br />6, 1995, marked Request No. 28708, copy of which is <br />attached hereto and made a part hereof, (hereinafter <br />collectively referred to "Right of Way Strip"), the <br />Company, subject to the limitations hereinafter set out, <br />shall have the right from time to time to enter and <br /> <br /> <br />
