WHEREAS, the staffs of the County Utilities Department and <br />WSACC frequently work closely together, and staff cooperation and <br />the coordination of facilities between the County and the WSACC <br />well serve the interests of the citizens of Cabarrus County and the <br />greater utility service area; <br /> <br /> NOW, THEREFORE, in consideration of mutual promises and <br />covenants contained herein, the County and the WSACC do hereby <br />agree as follows: <br /> <br /> ~GRBIMBNT <br /> <br /> 1. ~it%aation Site: In exchange for a lease of approximately <br />1100 square feet of designated space in the Utilities Building, the <br />WSACC agrees to transfer to the County those ~17 acres of the <br />RRRWWTP in the flood plain adjacent to Irish Buffalo Creek, <br />generally described in Exhibit A attached hereto, for mitigation <br />for the Coddle Creek Reservoir (the "Mitigation Site"), subject to <br />three (3) rights-of-way as shown on Exhibit A. The respective <br />rights-of-way are a 60-foot right-of-way for the electrical power <br />line to be granted to the City of Concord, a 30-foot right-of-way <br />parallel to and adjacent to the power line right-of-way for a <br />future sewer line, and a 100-foot right-of-way along Rocky River <br />for future construction of an effluent outfall line to the <br />confluence of Rocky River and Irish Buffalo Creek. <br /> <br /> 2. office Space. In exchange for the transfer of the <br />Mitigation Site, the County agrees to lease to the WSACC <br />approximately 1100 square feet of designated space, including <br />utilities, in the Utilities Building, as set forth generally on <br /> <br /> <br />
