136 <br /> <br />WHEREAS, private property owners have agreed to provide partial <br />funding for the provision of sanitary sewer service; and <br /> <br />WHEREAS, a request is being made to the Cabarrus County Board of <br />Commissioners to provide the remaining necessary funding; and <br /> <br />WHEREAS, sanitary sewer service will be available to additional <br />properties in the crossroads area and those property owners will not <br />have contributed to the expense of extending service; <br /> <br />NOW, THEREFORE, be it resolved chat the Cabarrus County Board of <br />Commissioners resolve: <br /> <br /> 1. That Cabarrus County supports the extension of sanitary sewer <br /> service to the crossroads area of U.S. 601 and N.C. 24/27; and <br /> 2. That the Cabarrus County Board of Commissioners agree to <br /> · provide the necessary remaining funding to make the extension <br /> of services possible; and <br />3. That the Cabarrus County Board of Commissioners establish a <br /> Crossroads Sanitary Sewer Service Availability Fee to obtain <br /> reimbursement of Cabarrus County funding; and <br />4. That the Crossroads Sanitary Sewer Service Availability Fee <br /> shall be collected by the following manner: <br /> a. A Crossroads Sanitary Sewer Service Availability Fee shall <br /> be required to be paid before any property or use may <br /> access the public sanitary sewer system in the crossroads <br /> area of U.S. 601 and N.C. 24/27. <br /> b. The availability fee shall be paid before any building <br /> permit may be issued for a use intended to be served by the <br /> sanitary sewer. <br /> c. That fee shall be calculated based upon the estimated sewer <br /> effluent of the existing/proposed use and the date of <br /> issuance of the building permit. <br /> d. The estimated effluent shall be calculated based upon N.C. <br /> State standards for estimating effluent based on use. That <br /> estimate shall be reduced by 25% to reflect local <br /> experience. The City of Concord Engineering Department <br /> shall be responsible for estimating effluent. In such <br /> cases, where there is no applicable use in the N.C. State <br /> standards, the City of Concord may use a comparable local <br /> use to estimate effluent. Estimates shall be in gallons per <br /> day. <br /> e. The availability fee shall then be calculated based on a <br /> cost per gallon of effluent with that cost increasing with <br /> time. <br /> f. The cost/gallon fee schedule will be determined by the date <br /> of issuance of the building permit and shall be as follows: <br /> (1) The availability fee will be $5/gallon expected <br /> effluent for all building permits issued before, <br /> during, and within 120 days of completion of the <br /> constrfiction of the sanitary sewer collection system <br /> and its connection to the Muddy Creek Wastewater <br /> Treatment Plant. <br /> (2) The availability fee will be $6/gallon expected <br /> effluent for all building permits issued more than <br /> 120 days after completion of construction and before <br /> July 1, 1997. <br /> (3) The availability fee will be $?/gallon expected <br /> effluent for all building permits issued between July <br /> 1, 1997 and 3une 30, 1998. <br /> (4) The availability fee will be $8/gallon expected <br /> effluent for all building permits issued on or after <br /> July 1, 1998. <br /> g. The existing Muddy Creek Drainage Basin Availability Fee <br /> adopted by the Board of Commissioners on February 6, 1995 <br /> shall not be charged on any development subject to the <br /> Crossroads Sanitary Sewer Service Availability Fee. <br />Adopted this the 22nd day of July, 1996. <br /> <br /> /s/ Jeffrey L.
