State of North Carolina
Department of Environment,
Health and Natural Resources
Division of Environmental Health

James B. Hunt, Jr., Governor
Jonathan B. Howes, Secretary
Richard K. Rowe, Director

MEMORANDUM

June 30, 1994

TO:

FR OM:

Local Environmental Health Directors, Supervisors and Coordinators

Susan C. Grayson, Head
Food, LodLdng and Institutional Sanitation Bran
Environmental Health Services Section
Division of Environmental Health

SUBJECT: L!mtted Foodservice Establishment Rules

The Limited Foodservice Establishment (LFSE) rule has now passed both
the Commission for Health Services and the Administrative Rule Review
Commission and becomes effective July 1, 1994. A copy of this rule is enclosed.
Note that this rule is now numbered. 2645 And will be located at the end of the
restaurant rules. Please review it carefully, as several changes were made in
accordance with the comments that were received. A Li'mit.ed Foodser~ice ~-'
Establishment operates from 16 to 60 days a year. The dates of operation do not
have to be consecutive.

The opening paragraph of . 2645 is one that should be referred to
constantly. It notes that all of the restaurant rules, except those mile numbers
listed, apply to rJmited Fo'~servtce Establishments. For example, Rule . 2601
(Definitions) does apply to LFSEs because it is .,not listed in the opening
paragraph of . 9.645. Rule . 2602 does not apply as LFSEs are exempted from . 2602
111 this opening paragraph.

Paragraph (1) lists the special permit requirements for LFSEs. These
permits are only good fro' a one year maximum (January 1 to December 31). All
LFSE permits expire on December 31 of each year. Transitional permits may not
be issued for Limited Foodservice Establishments because Rule . 2602 does not
apply to LFSEs (refer to the opening paragraph of. 2645).

The permit for a Limited Food Service Establishment should be issued to the
highest level person (G.S. 130A-2 defines a "person" as ,,An individual,
corporation, company, association, partnership, unit of local government or
other legal entity") with responsibility for the ruFSE. For example, the permit for

P.O. Box 27687, Raleigh.
