Grayson, Head <br />Food, LodLdng and Institutional Sanitation Bran <br />Environmental Health Services Section <br />Division of Environmental Health <br /> <br />SUBJECT: L!mtted Foodservice Establishment Rules <br /> <br /> The Limited Foodservice Establishment (LFSE) rule has now passed both <br />the Commission for Health Services and the Administrative Rule Review <br />Commission and becomes effective July 1, 1994. A copy of this rule is enclosed. <br />Note that this rule is now numbered. 2645 And will be located at the end of the <br />restaurant rules. Please review it carefully, as several changes were made in <br />accordance with the comments that were received. A Li'mit.ed Foodser~ice ~-' <br />Establishment operates from 16 to 60 days a year. The dates of operation do not <br />have to be consecutive. <br /> <br /> The opening paragraph of . 2645 is one that should be referred to <br />constantly. It notes that all of the restaurant rules, except those mile numbers <br />listed, apply to rJmited Fo'~servtce Establishments. For example, Rule . 2601 <br />(Definitions) does apply to LFSEs because it is .,not listed in the opening <br />paragraph of . 9.645. Rule . 2602 does not apply as LFSEs are exempted from . 2602 <br />111 this opening paragraph. <br /> <br /> Paragraph (1) lists the special permit requirements for LFSEs. These <br />permits are only good fro' a one year maximum (January 1 to December 31). All <br />LFSE permits expire on December 31 of each year. Transitional permits may not <br />be issued for Limited Foodservice Establishments because Rule . 2602 does not <br />apply to LFSEs (refer to the opening paragraph of. 2645). <br /> <br /> The permit for a Limited Food Service Establishment should be issued to the <br />highest level person (G.S. 130A-2 defines a "person" as ,,An individual, <br />corporation, company, association, partnership, unit of local government or <br />other legal entity") with responsibility for the ruFSE.
