<br />(c) For purposes of this definition, construction of a new source has
<br /> commenced if the owner or operator has:
<br />
<br />(1)
<br />
<br />Begun, or caused to begin as part of a continuous on-site
<br />construction program:
<br />
<br />(A) Any placement, assembly, or installation of
<br /> facilities equipment.
<br />
<br />Significant site preparation work including
<br />clearing, excavation, or removal of existing
<br />buildings, structures, or facilities which is
<br />necessary for the replacement, assembly, or
<br />installation of new source facilities or equipment;
<br />or
<br />
<br />(2)
<br />
<br />Entered into a binding contractual obligation for the purchase of
<br />facilities or equipment which are intended to be used in its
<br />operation within a reasonable time. Options to purchase or
<br />contracts which can be terminated or modified without substantial
<br />loss, and contracts for feasibility, engineering, and design
<br />studies do not constitute a contractual obligation under this
<br />definition.
<br />
<br />Nitrogen as ~mmonia (NH~) as a~unonia shall mean the initial product in
<br />the decompositions of nitrogenous organic matter as measured by using
<br />standard laboratory methods, as set out in this article, expressed in
<br />mg/1.
<br />
<br />Non-discharge Permit shall mean a disposal system permit issued by the
<br />State pursuant to N.C.G.S. 143-215.1.
<br />
<br />Non-domestic Wastewater shall mean the liquid wastes resulting from the
<br />processes employed in industrial, manufacturing, trade or business
<br />establishments, as distinct from domestic wastes.
<br />
<br />34. NPDES or National Pollutant Discharge Elimination System shall mean the
<br /> permit issued pursuant to Section 402 of the Act (33 U.S.C. 1342), or
<br /> pursuant to N.C.G.S. 143-215.1 by the State under delegation from EPA.
<br />
<br />35. Pass Through shall mean a discharge which exits the POTW into waters of
<br /> the State in quantities or concentrations which, alone or with
<br /> discharges from other sources, causes a violation, including an
<br /> increase in the magnitude or duration of a violation, of the POTW's
<br /> NPDES or Non-discharge Permit or a downstream water quality standard.

<br />Person shall mean any individual, firm, company, partnership,
<br />corporation, association, joint stock company, trust, estate,
<br />governmental entity or any other legal entity, or their legal
<br />representatives, agents or assigns. This definition includes all
<br />Federal, State, and local government entities.
<br />
<br />pK shall mean a measure of the acidity or alkalinity of a substance,
<br />expressed as standard units, and calculated as the logarithm (base 10)
<br />of the reciprocal of the concentration of hydrogen ions expressed in
<br />grams per liter of solution. A pH value of 7.0 is neutral, above 7.0
<br />is alkaline and below 7.0 is acid.
<br />
<br />Pollutant shall mean any "waste" as defined in N.C.G.S. 143-213 (13)
<br />and dredged spoil, solid waste, incinerator residue, sewage, garbage,
<br />sewage sludge, munitions, medical wastes, chemical wastes, biological
<br />materials, radioactive materials, heat, wrecked or discharged
<br />equipment, rock, sand, cellar dirt and industrial, municipal, and
