Charges for flow to the POTW not directly attributable to the users shall be <br />distributed among all users of POTW based upon the volume of flow of the <br />users. <br /> <br />Section 10-3.3 Surcharges. <br /> <br />Ail industrial users of the POTW are subject to industrial waste surcharges on <br />discharges which exceed the following levels: <br /> <br /> BOD - 300 MG/L <br /> COD - 675 MG/L <br /> TSS - 175 MG/L <br /> NH) - 15 MG/L <br />Oil/Grease - 100 MG/L <br />Aluminum - 1.80 MG/L <br />Arsenic - 0.003 MG/L <br />Cadmium - 0.003 MG/L <br />Copper - 0.090 MG/L <br />Chromium - 0.020 MG/L <br />Cyanide - 0.041 MG/L <br />Lead - 0.049 MG/L <br />Mercury - 0.0003 MG/L <br />Nickel - 0.021 MG/L <br />Silver - 0.005 MG/L <br />Zinc - 0.176 MG/L <br /> <br />The amount of surcharge will be based upon the mass emission rate (in pounds) <br />discharged in excess of the levels listed above. An industrial user shall never <br />increase the amount of water to dilute pollutant concentrations to avoid or reduce <br />surcharges. The amount charged per pound of excess will be set forth in the <br />Surcharge Rate Schedule. <br /> <br />ao <br /> <br />The volume of flow used in determining the total discharge of wastewater for <br />payment of user charges and surcharges shall be based on the following: <br /> <br />Metered water consumption as shown in the records of meter readings <br />maintained by the Authority. If a person discharging wastewater into <br />the public sewers produces evidence to the Executive Director that a <br />significant percent of the total annual volume of water used for all <br />purposes does not reach the public sewers, then an estimated percentage <br />of total water consumption to be used in determining nondomestic <br />wastewater discharge may be agreed upon between the Executive Director <br />and the person discharging such nondomestic wastewater into the public <br />sewer. The Executive Director shall ascertain whether substantial <br />evidence has been provided to prove a significant percent of water does <br />not reach the public sewers; or <br /> <br />If required by the Authority or at the individual discharger's option, <br />other flow monitoring devices which measure the actual volume of <br />wastewater discharges to the sewer. Such devices shall be accessible <br />and safely located, and the measuring system shall be installed in <br />accordance with plans approved by the Authority. The metering system <br />shall be installed and maintained at the users expense according to <br />arrangements that may be made with the Authority. <br /> <br />Where any user procures all or part of his water supply from sources <br />other than the County, the user shall install and maintain at his own <br />expense water meters of a type approved by the Administrator for the <br />purposes of determining the proper volume of wastewater discharged to <br />such sewers. <br /> <br />The character and concentration of wastewater used in determining surcharges <br />shall be determined by samples collected and analyzed by the Authority. <br />Samples shall be collected in such manner as to be representative of the <br />actual discharge and shall be analyzed using procedures set forth in 40 CFR <br />Part 136. <br /> <br /> <br />
