(a) <br /> <br />Bypass was unavoidable to prevent loss of life, personal injury, <br />or severe property damage; <br /> <br />(b) <br /> <br />There were no feasible alternatives to the bypass, such as the <br />use of auxiliary treatment facilities, retention of untreated <br />wastes, or maintenance during normal periods of equipment <br />downtime. This condition is not satisfied if adequate back-up <br />equipment should have been installed in the exercise of <br />reasonable engineering judgement to prevent a bypass which <br />occurred during normal periods of equipment downtime or <br />preventive maintenance; and <br /> <br />(c) <br /> <br />The user submitted notices as required under paragraph (b) of <br />this section. <br /> <br />The Executive Director may approve an anticipated bypass, after <br />considering its adverse effects, if the Executive Director determines <br />that it will meet the three conditions listed in paragraph (c)(1) of <br />this section. <br /> <br />Section 10-11 Tampering with, Damaging Sewerage Works. <br /> <br />No person shall maliciously, willfully or negligently break, damage, destroy, <br />uncover, deface or tamper with any structure, appurtenance or equipment which is a <br />part of the wastewater treatment system. <br /> <br />Section 10-12 New Construction. <br /> <br />New sewers and new connections shall be properly designed and constructed in <br />accordance with such guidelines as published by the Environmental Protection Agency, <br />reference 40 CFR, Section 35.927-4. All new construction shall conform with the <br />North Carolina plumbing codes. <br /> <br />Section 10-13 Use of Public Sewers. <br /> <br />The owner of any house, building, or property used for human occupancy, employment, <br />recreation, or other purposes under the jurisdiction of this Article and abutting <br />on any street, alley, or rights-of-way in which there is or may be located a <br />wastewater sewer connected to the treatment facility of the Authority, is required <br />at the owner's expense to install suitable toilet facilities therein and to connect <br />such facilities directly to the proper sewer in accordance with the provisions of <br />this ordinance, within ninety (90) days after date of official notice to do so <br />provided the proper wastewater sewer is within three hundred (300) feet of the <br />property line. This section shall not apply to any person served by a privately <br />constructed, owned, operated, or maintained wastewater sewer and wastewater <br />treatment facility that discharges directly to a natural outlet in accordance with <br />the provisions of this Article and applicable State and Federal laws. <br /> <br />Section 10-14 Private Sewage Disposal. <br /> <br />Regulations concerning private sewage disposal will be enforced by the Cabarrus <br />County Health Department in accordance to 10 NCAC 10A.1900. <br /> <br />Section 10-15 Outside Connections. <br /> <br />Any person owning or controlling premises located beyond the corporate limits or <br />boundaries of the Authority and desiring to install a plumbing system for the <br />purpose of discharging domestic sewage and/or industrial waste into the POTW may do <br />so by complying with the requirements of this Article and of the public utility <br />having jurisdiction over the sanitary sewer to which the connection is proposed to <br />be made. <br /> <br />Section 10-16 User Fees. <br /> <br />The Board of Directors shall approve all rates and fees to be assessed to each user <br />class. Every user of the sewer system will pay the appropriate fees as determined <br />by the Executive Director. <br /> <br />66 <br /> <br /> <br />
