The vote was unanimous. <br /> <br />The Chair introduced the third item on the Agenda, Variance l16(V): <br /> <br />Applicant: Service Distributing Company, Inc. <br />..Request: Variance l16(V) <br /> <br />The Chair stated to the Board and citizens that we are now going into our Board <br />of Adjustment function. In this capacity we serve as a quasi judicial board and <br />we will need sworn testimony. To approve this variance there must eight of <br />nine out of the affimtative. <br /> <br />The Chair then swore in Mr. Robert Gresham, Vice President of Service <br />Distributing Company, Mr. Charles Akin, Director of Construction and <br />Maintenance for Service Distributing Company, Mr. Michael Downs, Zoning <br />Administrator. <br /> <br />Mr. Downs, Zoning Administrator, addressed the Board presenting the variance <br />application and staff analysis. He stated that they are requesting three driveway <br />cuts on each thoroughfare, however, Mr. Akin just infoo-aed him that they are <br />only requesl~ng two. As evidence Mr. Downs presented the site plan, a letter <br />from Mr. C. D. Napier, Right Of Way Agent for NCDOT, an analysis by the <br />Cabarrus County Transportation Planner, a list of adjacent property owners, the <br />letter of notification, and the public hearing notice. <br /> <br />Mr. Jeter asked what is the variance at hand if they were wanting three per lot <br />and now they are only wanting two? <br /> <br />Mr. Downs said they combined the lots to make one lot, now they are wanting <br />two on each thoroughfare. Mr. Downs said if that is inaccurate, then the <br />application is inaccurate. <br /> <br />Mr. Newton, Director, said it is that plus it is also a variance on the 125 feel <br /> <br />Mr. Jeter said if we were to stipulate that two accesses on either road were okay, <br />we have a distance problem. <br /> <br />Mr. Newton said without going into the hearing part, the board is actually going <br />to look at two distinct issues. It is somewhat up to the attorney as to whether or <br />not to handle it together. You are looking at granting two curb cuts versus one <br /> <br /> <br />
