Several of these owners expressed concerns about the existing <br />business. Some of these concerns were appearance, noise, traffic, and operating hours. <br /> <br />Section 14-10 (Step 3) of the Cabarrus County Zoning Ordinance states that "the decision <br />to approve or deny will be based on the tbllowing criteria: (These criteria are base on the <br />existing nonconforming use.) <br /> <br />a. Noise. Does the nonconformity create noise above and beyond levels considered <br />normal to the area'?. All of the adjacent owners x~,ho contacted our office stated that the <br />existing use does create noise that is not customary in a residential area. Mainly the trucks <br />running and dumping at all hours of the day and night. The front end loader was also <br />mentioned. <br /> <br />b. Traffiq. Does the nonconformity generate or have tile potential to generate a <br />significantly higher volume of traffic than the surrounding land use? The adjacent owners <br />showed concern about the large trucks traveling on Robinson Church Road. <br /> <br />c. Other measurable, physical effects. Does the nonconformity generate any other <br />negative effects includihg but not limited to dust, air pollution, foul smell, etc.? The <br />adjacent owners stated that during the dry periods of the year there has been an occasional <br />problems with dust. Another concern was that material being carried on the trucks to and <br />from the site has flown offofthe trucks onto the road and other cars. <br /> <br />d. Surrounding Properly Values. Does tile nonconformity detract from the prevailing <br />property values? Although there were concerns shown about the possibility of adjacent <br /> <br /> <br />
