page -2-

property values being affected but without an expert in the real estate appraisal field this
would be hard to prove.

e..A~sthetics. Does the nonconformity compliment or detract from the overall aesthetic
character of the area.'? The appearance of the business from the road was stated as a
concern by the adjacem property owners. Their main concern was the piles of landscaping
materials placed at the road.

Another concern which was brought up was the filling and stock piling of material along
the creek bank. This is a legitimate concern. I would like to remind you that Cabarrus
County has a River/Stream Buffer Overlay Zone that restricts any type of activity within a
minhnum of fifty (in some cases more)of a river or stream.

After discussing both 3'our present operation and your proposed expansion with your
neighbors, I inspected fl~e site myself and found some of the same concerns. With tl'fis in
mind, I cannot issue a "Certificate of Nonconforming Adjustment" for your proposed
modular office building.

Section 14-I0 also states "If the Zoning Administrator, after an analysis of the facts of the
situation, finds the nonconformity cannot be adjusted, it will be handled as such and
subject to those provisions o£this Ordinance which deal with unreformable
nonconformities. A denied applicant may petition the Planning & Zonin~ Commission.
actin~ as a Board of Ad.iustment for review of the Zonin,o Administrator's decision within
30 days".

If you have any further questions or would like information about the appeal process,
please call our office at 788-8137.

Michael Do~ns
Zoning Administrator
