Planning and Zoning Commission Minutes <br />May 18, 1995 <br /> <br />Page 17 <br /> <br />The Chair introduced the sixth item on the Agenda, Zoning Atlas Amendment, <br />Petition 95-04: <br /> <br />o <br /> <br />Applicant Jimmy Plott <br />Request: Rezoning of Property from MDR to GC-Special Use <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from Mr. Jimmy Plott, Petition 95-04, to have his <br />property located on Robinson Church Road at Reedy Creek, <br />rezoned from MDR to GC-Special Use, to make the existing sand, <br />gravel and landscape material business conforming and to allow <br />replacement of the existing office. <br /> <br />Mr. ~onathan B. Marshall, Staff Member, addressed the Board <br />presenting Petition 95-04 and Staff Analysis stating this is a request <br />that would make this nonconforming business conforming through <br />a special use zoning. Mr. Marshall said because of the evidence <br />provided in the process for the Certificate of Nonconforming <br />Adjustment, the long range plan and the overall zoning plan, we <br />cannot recommend this petition. He said there is a letter attached <br />to the packet from Mr. C.F. Little Construction, Mr. Buck Little, <br />indicating their support of this rezoning. Mr. Marshall then gave <br />to the Chair a petition in opposition to the rezoning. <br /> <br />Mr. Gerald A. Newton, Director, said since this is a special use <br />rezoning, we will need to have sworn testimony. <br /> <br />The Chair opened the public hearing on Petition 95-04 asking if anyone would <br />like to speak for or against this petition to come forward and be sworn in. <br /> <br />The Chair then swore in Mr. Gary Howell, Site Manager for ~im's <br />Sand & Stone, Inc., Mr. Tony Eury, Resident, Mr. Brian Little, <br />Resident, Mr. Gary Wood, Resident, Mr. Gerald Bridges, Resident, <br />Mr. David Douglas, Resident, Mr. Ed Small, Resident, Dr. Brett <br />Stuart, representing the Board of Directors for Bradford Park Home <br />Owners Association, Rev. Earl Helms, and Rev. Ray Helms. <br /> <br />Mr. Gary Howell, Site Manager for Jim's Sand & Stone, Inc., <br />addressed the Board presenting them with a petition in favor of <br />this rezoning. Mr. Howell said they are asking for a special zoning <br /> <br /> <br />
