Planning and Zoning Commission Minutes
May 18~ 1995

Page 20

Mr. Newton said no. That would be outside their ability as a
board. They would not be able to deny the rezoning and then put
on some condition. You could ff you approved it, but it would
have to be agreed by the applicant for it to be a binding condition
because it is a special use.

The Chair said the main concern the adjacent property owners
have is the noise.

The Chair reopened the public hearing on Petition 95-04 asking the
petitioner if he could answer the property owners concerns about
the noise.

Mr. Howell said first of all, their request to put a modular building
on the property was no way connected with their operational
habits. He said their first petition was to improve their property in
making it more accessible to their customers. Mr. Howell said they
cannot make any money with the trucks in the yard.

Mr. Jeter said to Mr. Howell that he has already indicated to the
board that their hours of operation are from 8 am to 5 pm. He
asked Mr. Howell if he was firing up the trucks prior to 8 o'clock in
the morning.

Mr. Howell said in emergency situations only, which is very
seldom.

Mr. Newton asked Mr. Howell to address or clarify what he means
by emergencies.

Mr. Howell said in the six months that he has worked there, they
have responded after hours once.

Mr. Newton said it has been a little bit unclear as we have talked
about it as to what the emergency is. It is a part of his business,
from his testimony, it is a supply to another person and it is on
occasions.

Mr. Hill asked Mr. Howell what restrictions or conditions would
he put on this in consideration for this request being approved that
would address the concerns of the neighbors.
