They would not be able to deny the rezoning and then put <br />on some condition. You could ff you approved it, but it would <br />have to be agreed by the applicant for it to be a binding condition <br />because it is a special use. <br /> <br />The Chair said the main concern the adjacent property owners <br />have is the noise. <br /> <br />The Chair reopened the public hearing on Petition 95-04 asking the <br />petitioner if he could answer the property owners concerns about <br />the noise. <br /> <br />Mr. Howell said first of all, their request to put a modular building <br />on the property was no way connected with their operational <br />habits. He said their first petition was to improve their property in <br />making it more accessible to their customers. Mr. Howell said they <br />cannot make any money with the trucks in the yard. <br /> <br />Mr. Jeter said to Mr. Howell that he has already indicated to the <br />board that their hours of operation are from 8 am to 5 pm. He <br />asked Mr. Howell if he was firing up the trucks prior to 8 o'clock in <br />the morning. <br /> <br />Mr. Howell said in emergency situations only, which is very <br />seldom. <br /> <br />Mr. Newton asked Mr. Howell to address or clarify what he means <br />by emergencies. <br /> <br />Mr. Howell said in the six months that he has worked there, they <br />have responded after hours once. <br /> <br />Mr. Newton said it has been a little bit unclear as we have talked <br />about it as to what the emergency is. It is a part of his business, <br />from his testimony, it is a supply to another person and it is on <br />occasions. <br /> <br />Mr. Hill asked Mr. Howell what restrictions or conditions would <br />he put on this in consideration for this request being approved that <br />would address the concerns of the neighbors. <br /> <br /> <br />
