If the board approves this rezoning and <br />the petitioner turns around six months from now and sells it, and <br />someone moves in and decide that they want to put 25 tractor <br />trailers down there, there will be no control over the property. <br /> <br />Mr. Newton said if you put a condition on and the applicant <br />agreed to that condition, it would be a binding condition on that <br />special use rezoning. If the applicant says that he does not agree to <br />it, then it is not. <br /> <br />Mr. ]eter said if the board puts a condition on it that allows a <br />certain number of trucks, and the petitioner says he is not going to <br />do that, does he still get the special use or is it denied? <br /> <br />Mr. Newton said you do not have that condition and then you as a <br />board decide whether or not you still want to vote for it without <br />that condition. <br /> <br />Mr. Jeter MOTIONED to close the public hearing on Petition 95-04, <br />seconded by Mr. Hill. The vote was unanimous. <br /> <br />Mr. Jeter MOTIONED to approve Petition 95-04 with the following <br />findings of fact and the following stipulations: <br /> <br />1. The business is going to continue to operate regardless of what <br />we do tonight. <br /> <br />2. The concerned residents have indicated their concerns about a) <br />dust; b) hours of operation; c) noise; and d) what happens in the <br />future if we give a special status to this tract of land. <br /> <br />3. To address the concerns of the citizens Mr. Jeter proposed the <br />following stipulations: 1) the hours of operations be restricted to <br />7:30 am to 5:30 pm six days a week with the exception of a bona- <br />fide emergency request by a emergency customer of the petitioner; <br /> <br /> <br />
