Planning and Zoning Commission Minutes
May 18, 1995

Page23

2) the petitioner carry on with his stated intention of putting the
asphalt apron out to eliminate or cut down on the dust; 3) the
petitioner accept the maximum limitation in the future of no more
than six trucks.

Mr. Jeter said he is open to any other stipulations that the board
may find appropriate.

Ms. Harkey said to continue the checking of the water.

Mr. Newton said we could not do that.

Ms. Harkey asked is checking of the water permanent or are they
just doing it for a short period.

Mr. Marshall said Carolina Water Services is a private utility
operating company that operates the water system in Bradford
Park as well as the private sewage treatment system that serves
Bradford Park and Cabarrus Woods among others. They are
upstream on a tributary to Reedy Creek and the monitoring is most
likely done to meet the legal requirements of Carolina Water
Service and the operation of that private treatment plant. They
must report to the State based on that. He said he does not think
that that has anything to do with this operation.

The Motion was seconded by Mr. Hill.

Mr. Howell said the test that is made by Carolina Water Services is
made almost two thirds past their property, it is not made
upstream.

The Chair asked the petitioner if he agrees with those stipulations.

Mr. Howell said he talked with Mr. Plott, and they have some
customers that do go to work at 7 o'clock. In some cases they send
the material home with the driver and he leaves and dispatches the
truck in the morning. Mr. Plott will not agree to the stipulations
prior to 6 o'clock in the morning, but he will agree with the
afternoon hours prior to 5:30 pm.
