Planning and Zoning Commission Minutes <br />May 18~ 1995 <br /> <br />Page24 <br /> <br />The Chair asked Mr. ~eter if he would amend his motion for the <br />hours of operation to make it 6 am until 5:30 pm? <br /> <br />Mr. Jeter said he would like to get a clarification from Mr. Newton. <br />He said we have a motion and a second, the petitioner has rejected <br />the motion, can we put the question on the motion as it stands? <br /> <br />Mr. Newton said you can vote on the motion that is on the floor to <br />be voted on. What that means it that that condition would not be <br />enforceable. <br /> <br />Mr. ~[eter amended his motion to allow Mr. Plo~s starting hour of <br />operation to be 6 am., seconded by Mr. Hill. <br /> <br />The Chair asked Mr. Plott to step forward so she can go over the <br />conditions with him and make sure that they are agreeable with <br />him. <br /> <br />The Chair said the motion has been made and seconded to approve <br />Petition 95-04 for special use rezoning on the conditions that <br /> <br />1. His hours of operations be limited from 6 am in the morning <br />until 5:30 pm, Monday through Saturday. <br /> <br />2. That the asphalt apron be completed at his entry way to cut <br />down on the dust and gravel going out onto the highway. <br /> <br />3. That he have a maximum of six trucks in operation. <br /> <br />4. Bona-fide emergencies. <br /> <br />Mr. Plott indicated his agreement to abide by those conditions. <br /> <br />The Chair asked all those in favor of approving Petition 95-04 as <br />amended to raise their right hand. The vote was 6 to 3. Mr. <br />Ritchie, Mr. Jeter, Mr. Hill, Ms. Harkey, Mr. Lane and Mr. Kiefer <br />for this petition. Mr. Brownlow, Mr. Moose and Ms. Stafford <br />against the petition. <br /> <br /> <br />
