Planning and Zoning Commission Minutes
Tune 15~ 1995

Page 3

Applicant; Planning~ Zoning~ Building Inspection Department
Request; Administrative Rezoning

This was a request to the Cabarrus County Planning and Zoning
Commission from the Cabarrus County Planning, Zoning, Building
Inspection Department, Petition 95-02, to have property located at
N.C. 73/Macedonia Church Road/Trinity Church Road rezoned
for administrative rezoning.

Mr. Jonathan B. Marshall Staff Member, addressed the Board
presenting Petition 95-02 stating that the board looked at this last
month approving the proposed rezonings to the south of Highway
73, but had issues with the properties to the north of Highway 73.
Mr. Marshall said the Austin's have indicated that they would
agree to the rezoning to L-I, which is proposed to be changed from
a Low Densi.ty Residential to a Limited Industrial. We have
readvertised Mr. Barbee's 78 acre parcel along with his desire to
have that zoned Medium Density Residential. Before you is a letter
from Mr. Maurice Ewing, Greater Cabarrus County Economic
Development Corporation, addressing this and the other petition.
Mr. Ewing is here this evening if the board would like to ask him
any questions.

Mr. B.J. Barbcc, Resident, addressed the Board stating he was here
last month requesting a MDR zoning on approximately 78 acres of
his home place. He said he knows he cannot stop progress, but if
he could get his land zoned MDR, he has a potential buyer who is
willing to build some nice single homes that would compliment the
area.

Mr. Starkey Sharp, Attorney representing Mr. Barbee, addressed
the Board stating that this property has bccn in Mr. Barbee's family
for a long time and they sort of set the tone for what they wanted
this property to be like. He said everytime the board considers a
zoning petition, there are three groups that they have to look at in
trying to decide what is best for the county. You look at what the
taxpayer has to say (the property owner), the affect on the
neighborhood and the affect of the whole county of what you are
about to do. Mr. Sharp said he thinks the most important thing is
