Planning and Zoning Commission Minutes <br />June 15, 1995 <br /> <br />Page 5 <br /> <br />Mr. Newton, Director, addressed the Board stating as Mr. Austin <br />has talked about, he has received a Certificate of Nonconformity <br />Adjustment, something that you need in this county to allow you <br />to move your house when it does not conform to zoning. Other <br />places, that would not be allowed. In our ordinance, Article 14 <br />refers to that discretion. What they cannot do is build a new house <br />in an industrial zone. The issue that you have in front of you is <br />where you are looking at the land use plans that have bce_n in place <br />in the county for several years. The land use plan cause for this <br />area to be industrial. When we found out the exact location of the <br />Westside Bypass, we looked to clean up some, that is what brought <br />this in front of the board. Basically when you look at a rezoning, <br />you need to look at the land use plan. That is the issue that <br />remains on one parcel of land which is part of Mr. Barbee's, the 78 <br />acres. <br /> <br />Ms. Renee Goolsby, Resident, addressed the Board stating that the <br />only thing she. is asking is that the board give them an opportunity <br />to continue to live in that area as a family and to pass it along to <br />her children. <br /> <br />Mr. Hill asked Mr. Newton if this is zoned industrial, would this <br />prohibit Mr. Barbee from selling his property to this proposed <br />buyer who wants to build homes there? <br /> <br />Mr. Newton said yes, because it is currently industrially zoned and <br />has been for 1 1/2 years industrial. <br /> <br />Mr. Hill asked Mr. Newton what is the justification for leaving it <br />industrial instead of letting him do with his property what he <br />wishes? <br /> <br />Mr. Newton said he will answer that, but first, he wants to back up <br />to one statement that he made just to make a counterpoint. Fie said <br />the fact that Mr. Barbee has someone who is interested in this <br />property for residential use does not necessarily mean that we have <br />precluded him from selling his land. It does perhaps to that <br />subdivider who wants to use it residentially. But it does not mean <br /> <br /> <br />
