Planning and Zoning Commission Minutes
/une 15, 1995

Page 10

Mr. Sharp withdrew his offer to make the zoning line correspond
with the 100 year flood plain boundary. He said their
interpretation of what that would mean is different from what Mr.
Marshall told them.

Mr. Jeter asked the Chair if they could ask Mr. Sharp to give the
board his interpretation of what that meant.

Mr. Sharp said they thought that that meant the 100 foot
requirement, part of it, could be used up and they would be the
sacrifical lamb for the 100 foot, but they thought it was going to
start at the property line with Dogwood. He said if they use the
line that they proposed earlier, which he would like to withdraw,
they are going to loose 75 to 100 feet on this side and another 100
feet on the other side. He said he does not believe that their
development plan would stand for that. His preference is that the
board consider the whole tract without the regard for the flood
line.

The Chair asked Mr. Hill if he wanted to restate his motion.

Mr. Hill said he is going to leave it as he previous stated it. A
straight rezoning of the whole property from Light Industrial to
Medium Density Residential.

The vote was 5 to 3, Mr. Ritchie, Mr. Hill, Mr. Moose, Mr. Lane and
Ms. Kiefer in favor of the petition, Mr. Brownlow, Ms. Stafford and
Mr. Jeter against the petition.

Mr. Newton said because it was a 5 to 3 vote, it automatically
becomes a recommendation to go on to the County Commissioners.
The Commissioners will hear this part at their July 17th meeting.

The Chair introduced the second item on the Agenda, Zoning
AmendmenV.

Arias
