Planning and Zoning Commission Minutes <br />June 15, 1995 <br /> <br />Page 9 <br /> <br />Sharp, that they were willing to adjust the zoning line to the 100 <br />year floodplain if it could be rezoned Medium Density Residential. <br />We therefore have a request to rezone Medium Density Residential <br />with the zoning line being the 100 year floodplain. The motion that <br />we have now is to deny that. <br /> <br />Mr. Jeter asked what would be the net gain to the industrial zoning <br />to the east of the floodplain? <br /> <br />Mr. Newton said what it does is limits the amount of buffering that <br />would be required over on the Dogwood property and it reduces <br />the amount of residential that would occur on this tract of Mr. <br />Barbee's. Mr. Newton said it also represents a buffering between <br />that residential parcel. If the residential zone adjoined Dogwood's <br />industrial zoning, there would be a larger buffer area required in <br />the industrial area. <br /> <br />Mr. Marshall said we require buffering between zones and uses <br />and that includes residential development. If the developing use is <br />a permitted residential and it abuts limited industrial, then they are <br />going to have to use the highest buffer yards. With a 58 acre <br />parcel, they are going to have to buffer 100 feet and include the <br />necessary plantings. So it will be the 100 year floodplain plus 100 <br />feet. <br /> <br />The Chair said there is a motion on the floor to deny the petition to <br />rezone Mr. Barbee's property from Light Industrial to Medium <br />Density, Residential and for it to remain Light Industrial she asked <br />if there was a second to the motion. Mr. Brownlow seconded the <br />motion. <br /> <br />The vote was 4 to 4, Mr. Brownlow, Mr. Lane, Mr. Jeter and Ms. <br />Stafford for the motion. Mr. Ritchie, Mr. Moose, Mr. Kiefer and <br />Mr. Hill against the motion. The motion was not approved. <br /> <br />Mr. Hill MOTIONED to approve the petitioners request to rezone <br />the property east of the bypass north of Highway 73 from Light <br />Industrial to Medium Density Residential, seconded by Mr. Kiefer. <br /> <br /> <br />
