Planning and Zoning Commission Minutes <br />October 19, 1995 <br /> <br />Page 4 <br /> <br />Mr. Lane asked Mr. Lowe how does he expect to enforce this. <br /> <br />Mr. Lowe said they are going to enforce it the same as they always <br />have if they are in violation. He said they would go out and give them <br />30 days to remove those junked vehicles if they are in violation. If <br />they are not moved then, then they would start their citation process. <br /> <br />The Chair opened the public hearing on Petition 95-05(T) asking if anyone would <br />like to speak for or against this petition to come forward. <br /> <br />. There being no one to speak for or against the petition, the Chair closed the public <br /> hearing on Petition 95-05(T). <br /> <br />There being no further comments, Mr. Jeter MOTIONED, seconded <br />by Mr. Drye to approve Petition 95-05(T) as submitted and include the <br />new corrections. The vote was unanimous. <br /> <br />The Chair introduced the second item on the Agenda, Administrative Rezoning: <br /> <br />Applicant: Cabarrus County Planning and Zoning Staff <br />Request: Administrative Rezoning <br /> <br />This was a request to the Cabarrus County Planning and Zoning <br />Commission from the Cabarrus County Planning and Zoning Staff, <br />Petition 95-07, to have property located on N.C. Highway 24/27 at <br />Old Camden Road rezoned from Limited Industrial to Limited <br />Commercial, to provide greater flexibility to property owners in using <br />their property while retaining the nonresidential zoning. <br /> <br />Mr. Jonathan Marshall, Staff Member, addressed the Board stating <br />that this rezoning was discussed at the last meeting. He said the staff <br />has looked at this and are continuing to update both the arias and <br />ordinance. He said the staff recommends that it be rezoned to Limited <br />Commercial. In particular, that is going to allow some residential <br />development of the property. Mr. Marshall said most of the property <br />owners that they have spoken with have seen the long term potential <br />for nonresidential use on this property, but feel like in the short term, <br />they should have some possibility of residential use. Mr. Marshall <br />said we have one property owner, Mr. Tony Harper, who does intend <br />to develop his property for a nursery and greenhouse, that is not <br />permitted under the limited commercial line item.
