NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this day of <br /> , 1995, by and between CITY OF CONCORD, a municipal <br />corporation of the State of North Carolina, hereinafter referred to as "CONCORD" <br />and CABARRUS COUNTY, a governmental subdivision of the State of North <br />Carolina, hereinafter referred to as "CABARRUS"; <br /> <br />WITNESSETH: <br /> <br /> That whereas, Concord operates a library in the municipal limits known as <br />"Cannon Memorial Library" and has operated the same for a number of years; and <br />whereas, Cabarrus makes appropriations to said library; and whereas, Cabarrus <br />has established a branch library in the City of Kannapolis and at future times may <br />desire to establish branch libraries in other parts of Cabarrus County; and <br />whereas, it is desired that Concord administer the entire library system in the <br />manner hereinafter provided for in this contract. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the mutual <br />agreements hereinafter made, the parties do agree as follows: <br /> <br /> 1. That Cabarrus has established a county library system with the first <br />branch being in the City of Kannapolis, North Carolina, and will fund said system <br />and will continue to make contributions to Concord for the operation of the <br />Cannon Memorial Library in the City of Concord. <br /> <br /> 2. That Concord will administer the entire library system and will be <br />solely responsible for the employment of the Head Librarian (Library Director) of <br />the system and for the employment of the staff of the Cannon Memorial Library. <br /> <br /> 3. The Head Librarian and all personnel in the Cannon Memorial Library <br />will be employees of Concord and all final decisions concerning them will be made <br />by Concord. <br /> <br /> 4. The Head Librarian and the Board of Library Trustees of Cabarrus will <br />recommend to the Cabarrus County Manager persons to be Chief Branch <br />Librarians for each branch of the library system. The County Manager will then <br />select and employ the Chief Branch Librarian for each branch. Each candidate <br />must be certified by the State of North Carolina. After consultation with the Head <br />Librarian, each Chief Branch Librarian, with the approval of the Cabarrus County <br />Manager, will hire personnel for the branch. The Chief Branch Librarians and all <br />branch personnel shall be County employees. <br /> <br /> <br />
