It ha~ been determined that the <br />proposed private use Helms Field Ultralight Flightpark, <br />Kannapolis, North Carolina, to be located at latitude <br />35o28~51"N., longitude 80°40'16"W., will not adversely affect the <br />safe and efficient use of the navigable airspace by aircraft, <br />provided: <br /> <br />Unless <br /> <br />All operations are conducted in VFR weather conditions. <br /> <br />The landing area is limited to private use. <br /> <br />All operations are limited to ultralight aircraft. <br /> <br /> extended, revised or terminated, this determination <br />expires in two years if the landing area is not in operation by <br />that time. Please notify the Hickory Federal Aviation <br />Administration Flight Service Station and complete the enclosed <br />FAA Form 5010-5 and mail to the address indicated within thirty <br />(30) days after the facility becomes operational. <br /> <br />This determination should not be construed to mean FAA approval <br />of the physical development involved in the proposal. It is only <br />a determination with respect to the safe and efficient use <br />airspace by aircraft. In making this determinations, the FAA has <br />considered matters such as the effect the proposal would have on <br />existing or contemplated traffic patterns of neighboring <br />airports, the effects it would have on the existing airspace <br />structure and projected programs of the FAA, and the effect.that <br />the existing or proposed manmade objects on file with the FAA and <br />natural objects within the affected area would have on the <br />airport proposal. This determination in no way preempts or <br />waives any ordinance, laws, or regulations of any other <br />governmental body or agency. <br /> <br />The FAA can evaluate proposed construction in the vicinity of <br />airports to determine if structures would be a hazard to air <br />navigation. However, we cannot prevent the construction of any <br />objects.
