Addendum #1 is submitted to cover changes in the following items of the original contract <br />(copy attached). <br /> <br /> 5. REIMBURSEMENT OF COSTS AND PAYMENT SCHEDULE. In <br />consideration of the CONTRACTOR'S performance under this Agreement, COUNTY in <br />accordance with the budgets which are attached hereto as Attachments B, C and E will <br />reimburse CONTRACTOR. The amount payable by COUNTY for the conduction of the <br />RESEARCH PROGRAM is $623,829 subject to any changes agreeable to both parties. <br /> <br /> Reimbursements shall be made to CONTRACTOR for cost incurred in the <br />RESEARCH PROGRAM on the following basis: <br /> <br /> a. Within thirty (30) days of the effective date of this Agreement, ten <br />point four percent (10.4%) of the total budgeted amount for planting, or $60,000.00. <br /> <br /> b. Thereafter, five equal payments of ten point four percent (10.4%), or <br />$60,000.00 will be made at quarterly intervals beginning April 15, 1992 and ending <br />on April 15, 1993, and one payment of $10,000, one point seven percent (1.7%) <br />November 15, 1993. <br /> <br /> c. Payments of $50,000, eight point six percent (8.6%) will be dispersed <br />February 15, March 15, and April 15, 1994. One payment of $11,649, two percent <br />(2.0%) will be dispersed May 15, 1994. Thereafter, four equal payments of $11,645 <br />two percent (2.0%) will be dispersed in April, 1995, 1996, 1997 and 1998. <br /> <br /> d. Reimbursements for surveying support services of $45,600.00 (7.3%) <br />shall be payable to CONTRACTOR July 15, 1994. <br /> <br /> e. The adjusted fee schedule enumerated in item 5c above is based on the <br />following facts and circumstances growing out of the specifications upon which the <br />original contract was based. In the 1992-1993 planting season all available sites were <br />planted with good stock on a timely basis, and there was very good initial survival. <br />During summer and fall, 1993, the western two-thirds of North Carolina experienced <br />extreme drought which caused heavy mortality on many sites by early fall. <br />Therefore, based on paragraph 1.06 "W. arranty", Item C. of the specifications, <br />COUNTY releases CONTRACTOR from all warranties, imposed or implied, <br />regarding survival and growth of tre~s and shimbs installed or improved during the <br />1992-1993 planting and growing season, ending on or about l~ovember 1, 1993. <br /> <br />2 <br /> <br /> <br />
