PETITION 94-05(t) <br /> <br /> AN ORDINANCE AMENDING THE <br />CABARRUS COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />1. Chapter 14, Section 14-6. Non-conforming use of premises (land with or without <br />structures). <br /> <br />Amend Paragraph entitled "Destruction" in Section 14-6 to read as follows: <br /> <br />Reconstruction of Damaged Structures: When a structure (excluding signs) containing a <br />nonconfomdng use is damaged by fire, wind, flood, or any other natural cause, such <br />structure may be reconstructed and used as before any such calamity, provided such <br />reconstruction takes place within one year of the calamity. However, if the cause of damage <br />is not of natural origin and the repair costs will equal or exceed 75 percent or more of the <br />tax assessed value; it must, if reconstructed, conform in all ways to this ordinance. <br />Calculation of the cost of damage will be that determined by the owner/operator's insurance <br />carrier. If uninsured or no insurance claim is filed, the amount of damage will be estimated <br />by a County Tax Assessor appraiser. <br /> <br />2. This Ordinance shall become effective upon its adoption. <br /> <br />Adopted this the __ day of <br />Commissioners. <br /> <br />, 1994 by the Cabarrus County Board of <br /> <br />ATYEST: <br /> <br />Jeffrey L.
