Heating and seeing none, the Chair asked if the board has any <br />discussion. <br /> <br />There being no further comments or discussion, Mr. Smith MOTIONED, to <br />approve Petition 94-03(t) zoning text amendment, seconded by Ms. Stafford. <br />The vote was unanimous. <br /> <br />New Business <br /> <br />The Chair introduced the first item of new business on the Agenda, Board of Adjustment <br />Function: <br /> <br />Applicant: Jerry Wayne Linker <br />Request: Conditional Use Permit 0191 (C) <br /> <br />This was a request to the Cabarrus County Planning and Zoning Commission <br />from Mr. Jerry Wayne Linker, 1419 Pembrook Drive, Concord, N.C. 28025 for <br />a Conditional Use Permit to assemble and operate a recreational facility (Rodeo, <br />Team Penning). <br /> <br />The Chair stated to the citizens that this board serves in a number of capacities. <br />As a board of adjustment, we serve in a quasi-judicial capacity and in this one <br />particular case this evening, the board will be evaluating a request for a <br />conditional use permit. The Chair then explained to the citizens that a conditional <br />use is one that is generally a permitted use in certain zoning districts. It is not <br />an outright permitted use, but it is one that if all of the conditions specified in our <br />ordinance are met, then we as a board are obligated to approve it as a conditional <br />use. The Chair also specified that in order to approve a conditional use permit, <br />the board must approve it by 80 percent of members present and that is a vote of <br />at least 8 in the affirmative. <br /> <br />The Chair opened the public hearing on Conditional Use Permit 0191(C) asking that any person <br /> <br /> <br />
