Planning and Zoning Commission Minutes <br />February 17, 1994 <br /> <br />Page 2 <br /> <br />The Chair said heating none, what the board has in front of them is that Ms. <br />Ne. al wishes to have an exception made for the right-of-way for a private road <br />running down Cee Jay Drive so that a 3 acre lot can be divided. But the board <br />found that if they divide that, then the board would have exceeded the standards <br />that we have in our subdivision regulations according to private road. They were <br />not able to meet the conditions of improving the road and putting the paved apron <br />at the end of the road, because they did not get the agreement of the adjacent <br />property owners. <br /> <br />There being no further comments, Mr. Nichols MOTIONED to deny Petition 94- <br />01(s), seconded by Mr. Smith. <br /> <br />The Chair stated for the record that this was a very difficult decision and that she <br />truly wished the property owners could have worked with Ms. Neal. <br /> <br />The vote was unanimous to deny Petition 94-01(s). <br /> <br />The Chair stated that the board has a zoning text amendment in front of them this <br />evening. The Chair said this is a proposed amendment to the new 1994 Cabarrus <br />County Zoning Ordinance. The Chair stated the board is now moving into the <br />Planning Board functions. In our planning board functions, we serve as an <br />advisory capacity to the Cabarrus County Board of Commissioners. We will have <br />a presentation by the staff, we except any public comment that is offered, and we <br />will discuss and take a vote and she will carry that vote as a recommendation to <br />the Commissioners who have final decision on our planning board activities. <br />Their meeting will be held on March 21, 1994, at 7:00 p.m. <br /> <br />Mr. Marshall, Staff Member, addressed the Board about Petition 94-03(0 zoning <br />text amendment stating this petition is for the purpose of altering the development <br />standards of the general industrial district. Mr. Marshall said there are four <br />changes proposed three of which are shown in the text amendment and one more <br />that he will highlight. Those changes are specifically to alter the lot size, to <br />reduce it from a 5 acre lot size minimum in this district to 1 acre, to add a <br />district size of 10 acres, meaning that no general industrial district, no matter how <br />many parcels make it up, shall be smaller than 10 acres. Mr. Marshall said they <br />would also alter the setbacks to 75 feet in the front, 30 feet side and rear. The <br />change that is not in the listing that would need to be made is currently the <br />minimum average lot width is 300 feet by altering the lot size to 1 acre, we feel <br />that this needs to be reduced and recommend 200 feet.
